ORDINANCE NO. 97-0-37 ADOPTED November 12, 1997
AN ORDINANCE: APPROVING REZONING APPLICATION #ZM-118 DRY MILL MANOR,
BY KL OLDE TOWNE, L.L.C.
WHEREAS, on April 30, 1990 Olde Towne Joint Venture made application to rezone
approximately 1.5 acres of land from F-1 (floodplain)to B-1 (downtown mixed use) and approximately 0.1
acre from B-1 to F-1 on a property located east of Dry Mill Road adjacent to Town Branch; and
WHEREAS, on July 19, 1990 the Planning Commission held a public hearing to consider rezoning
application #ZM-118 Dry Mill Manor; and
WHEREAS, on July 26, 1990 the Planning Commission recommended approval ot' rezoning
application #ZM-118 Dry Mill Manor; and
WHEREAS, on October 12, 1993 the Town Council held a public hearing to consider rezoning
application #ZM- 118 Dry Mill Manor; and
WHEREAS, on October 19, 1997 the application was referred to the Planning and Zoning
Committee who elected to defer action until issuance of a Letter of Map Revision (LOMR) by the Federal
Emergency Management Agency (FEMA); and
WHEREAS, the Town has completed necessary channel improvements to Town Branch that
resulted in the removal of approximately 1.5 acres of land from floodplain and 0.1 acres being added to
floodplain; and
WHEREAS, on March 14, 1997 FEMA issued a LOMR redefining the limits of floodplain on
Town Branch consistent with the completed channel improvements.
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. Rezoning application #ZM-118 Dry Mill Manor, by KL Olde Towne, L.L.C., is
hereby approved and the Town of Leesburg Zoning District Map is amended to change the zoning of
approximately 1.5 acres of land from F-1 to B-1 and 0.1 acres of land from B-1 to F-1 on a property

described as LCTM 48A, Block 3, Parcels 7 and 7A as shown on the Rezoning Plat prepared by Paciulli,
Simmons & Associates, Ltd. and dated April 13, 1997, revised October 15, 1997.
SECTION II. Rezoning approval does not express or imply any waiver or modifications to any
requirements of the Design and Construction Standards Manual, Subdivision and Land Development
Regulations or Zoning Ordinance unless specifically cited herein.
SECTION III. This ordinance shall be effective upon its passage.
