HomeMy Public PortalAboutOrdinances-2008-293 TIFFIN ORDINANCE NO 2008-293 AN ORDINANCE AMENDING ORDINANCE NO. 1979-85 BY INCREASING THE BOND AMOUNT AND AMMENDING PENALTY PROVISIONS. BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose: The purpose of this ordinance is to amend Ordinance No. 1979-85 to increase the amount of the bond that peddlers and solicitors must obtain and to allow prosecution of violations as municipal infractions. Section 2. Amendment: City of tiffin Ordinance No. 1979-85. Section VIII is deleted and in lieu thereof the following provision is adopted: SECTION VIII. Bond Required. Before the Clerk may issue a license under this Ordinance, each applicant must post a bond of$1,000 with the City Clerk. The bond must indemnify and pay the City for any penalties or costs occasioned by the enforcement of this ordinance. The bond must remain effective until after 30 days from the expiration of the license. Section 3. City of Tiffin Ordinance No 1979-85, is amended to have the following provision added as Section XIV: SECTION XIV. Violation Penalty. Any violation of this ordinance may beef prosecuted as a municipal infraction for each day the violation continues. This provision does not prohibit the use of a simple misdemeanor violation, but it creates an additional remedy. The City retains sole discreation to decide which remedy to pursue. The City may not pursue both remedies for a single violation. Penalties and relief for a judgment of a municipal infraction are those set forth in the relevant provisions of the Iowa Code. On the 13th day of August 2008, at a regular meeting of the Tiffin City Council, Tiffin, Iowa. Councilperson Mike Gericke introduced Ordinance No. 2008-293, and moved that it be given its first reading. The motion was seconded by Councilperson John Wright. Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, and John Wright. Nayes: None. 5 Members of the City Council being present and having voted Aye, Mayor Royce Phillips declared the motion carried, and Ordinance No. 2008-293, was read the first time and discussed and placed on record. On the 10th day of September 2008, at a regular meeting of the Tiffin City Council, Tiffin, Iowa. Councilperson Mike Gericke introduced Ordinance No. 2008-293 and moved that it be given its second reading. The motion was seconded by Councilperson Mark Petersen. Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, and John Wright. Nayes: None 5 members of the City Council being present and having voted "Aye, Mayor Royce Phillips declared the motion carried, and Ordinance No. 2008-293, was read the second time and discussed and placed on record. On the 8th day of October 2008, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson John Wright introduced Ordinance No. 2008-293, and moved that it be given its third and last reading. The motion was seconded by Councilperson Mike Gericke. Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, and John Wright. Nayes: None 5 members of the City Council being present and having voted "Aye", Mayor Royce Phillips declared the motion carried, and the ordinance was passed and adopted. Whereupon the Mayor declared that Ordinance No. 2008-293, be adopted and signified his approval of same by fixing his signature thereto. Passed by the City Council on the 8th day of October 2008 and approved by the Mayor on the 8th day of October 2008.
