AN ORDINANCE: PRESENTED April 14, 1998 98-0-04 ADOPTED April 14, 1998 APPROVING SPECIAL EXCEPTION APPLICATION #SE-97-08 CORNERSTONE CHAPEL DAY CARE/PRESCHOOL and place a time limit on this special exception use; and WHEREAS, this request is consistent with the general regulations of the Zoning Ordinance. THEREFORE, ORDAINED by the Town Council of Leesburg in Virginia as fol][ows: SECTION I. Special Exception Application #SE-97-08 Cornerstone Chapel Day Care/Preschool, further identified as Tax Map 60((6)) Parcel C, and as shown on the Botmdary Survey prepared by Ken W. Efickson, Inc. dated June 25, 1996, as revised November 21, 1997, is hereby approved subject to the following conditions: 1. This special exception for day care/preschool is valid for a period not to exceed ten (10) years fi.om the date of approval. 2. This special exception for day care/preschool is valid only so long as Cornerstone Chapel continues in this location. 3. Cornerstone Chapel complies with all state requirements governing child ,care centers. WHEREAS, on March 24, 1998, the Town Council held a public hearing on this application; WHEREAS, this use may conflict with future industrial uses in this zone, it is appropriate to WHEREAS, Cornerstone Chapel has requested special exception approval to operate a day care/preschool program at the existing church facility at 742 Miller Drive S.E.; and WHEREAS, on March 19, 1998, the Planning Commission recommended[ to Council approval, with conditions, of Special Exception Application #SE-97-08 Cornerstone Chapel Day Care/Preschool; and -2- AN ORDINANCE APPROVING SPECIAL EXCEPTION CORNERSTONE CHAPEL DAY CARE/PRESCHOOL APPLICATION #SE-97-08 4. The total number of children cared for shall not exceed 120. 5. A fence at least three and one half feet in height shall be constructed around the outdoor designated play area. 6. The remainder of the landscaping is installed pursuant to the approved development plan. SECTION II. Special exception approval does not express or imply any waiver or modification to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations, or Zoning Ordinance except as specifically cited herein.
