I . ROLL CALL
President Duffy called the meeting to order at 12 :13 P.M.
Members Present: Katherine Duffy, Barbara Green and Daniel
Wendin.
Personnel Present: Herbert Grench, Edward Jaynes, Jon Olson,
Anne Crosley and Carroll Harrington
Audience of two persons.
EXECUTIVE SESSION
The Board recessed to Executive Session to discuss land nego-
tiations.
PUBLIC HEARING
The Board reconvened at 12:20 P.M. to conduct the public portion
of the meeting.
A. Possible Acceptance of 212en §pace Easement
H. Grench introduced his memorandum (M-75-93) dated June 27 ,
1975, regarding the Possible Acceptance of an Open Space Ease-
ment by the District. He explained that the owners of a 20
acre parcel of densely wooded land near Mt. Madonna County Park
were offering to donate a scenic easement on the property to
the District. The offer must be accepted by June 30 , however,
because the property would revert to the ownership of the State
on July 1 , 1975 due to an accumulation of five years ' delinquent
taxes on the property. He noted that the property itself had
been offered as a donation to the District, but because it was
not within the District' s boundaries and back taxes were due,
it would not have been in the best interest of the District to
accept that offer. Consequently a scenic easement donation
was offered, he said, which would have the effect of requiring
any owner of the property to seek permission from the District

for any alteration of the scenic nature of the property. The
District would not have the responsibility of patrolling the
land, but there would not be public access, either. H. Grench
pointed out that this was the District's first opportunity to
preserve open space through acquisition of a scenic easement,
and that the easement was also a donation. He recommended
that the Board accept the gift of a scenic easement on the
property.
K. Duffy opened the public hearing at 12 :25 P.M.
There were no comments.
K. Duffy closed the public hearing at 12 :26 P .M.
Motion: K. Duffy moved adoption of Resolution No. 75-14 , a
Resolution of the Board of Directors of the Midpen-
insula Regional Park District Accepting Gift of Scenic
Easement and Authorizing President to Execute Certif-
icate of Acceptance with Respect Thereto. B. Green
seconded the motion.
Discussion: E. Jaynes advised that the form of deed
used for the scenic easement donation was the form
recognized by the State of California. He said a
scenic easement was a type of open space easement,
but that distinctions among open space easements , con-
servation easements and scenic easements often de-
pended on the provisions set forth in the individual
documents. The motion passed unanimously.
IV. NEW BUSINESS REQUIRING ACTION
A. Assembly Bill 1164 and Other Legislation
H. Grench introduced his memorandum (M-75-92) dated June 27,
1975 , regarding Assembly Bill 1164 and Other Legislation. He
advised that AB 1164 , which was originated by the Midpeninsula
Regional Park District, had passed the Assembly and is now
on the Senate floor. He referred the Board to copies
of an attached press release from the East Bay Region-
al Park District which ,announced East Bay's opposition to
AB 1164. He said he was surprised at the opposition to the
bill, since all the regional park districts were aware of the
pending legislation and had been consulted periodically by
phone, letter and personal meetings about the legislation.
Both Marin County and Monterey Peninsula Regional Park Dis-
tricts responded to requests for comments and support; however,
no response was ever received from East Bay prior to the
press release. H. Grench added that on a number of occasions,
East Bay had introduced legislation without notifying other
regional park districts , which had resulted in last-minute
efforts to clarify or change the legislation. He said the

above-mentioned events indicated there was a lack of communica-
tion between the East Bay and Midpeninsula Regional Park Dis-
tricts. He advised that he had drafted a letter to be sent
from the President of this Board to the President of East Bay 's
Board of Directors , and he recommended the Board approve the
sending of the letter.
D. Wendin said he felt it would be better to call East Bay
officials prior to sending the letter to determine what the
specific reasons were for their Board's opposition to the
proposed legislation.
K. Duffy said she would be willing to personally visit East
Bay officials if that would be helpful.
Motion: D. Wendin moved that staff be directed to contact
the East Bay Regional Park District to determine
the basis for their opposition to AB 1164 and, on
the basis of that information, draft a letter for
the Board President 's signature asking for their
support. K. Duffy seconded the motion. The motion
passed unanimously.
V. ADJOURNMENT
The meeting was adjourned at 12 :58 P.M.
