APPROVING CHANGE ORDER # 2
AND FINAL PAYMENT TO DEFINO CONTRACTING, CO. /
2003 MISCELLANEOUS BASE REPAIR PROGRAM
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a
contract DeFino Contracting, Co. in the amount of $59,490.00 for the 2003
Miscellaneous Base Repair Program; and
WHEREAS, the Borough's Consulting Engineer for the project, T & M Associates, has
advised the Governing Body that a modification of the contract is reasonable and
necessary due to certain emergency roadway conditions threatening the health and safety
of the traveling public and has recommended that the aforesaid contract be modified in
accordance with Contract Change Order #2 (See attached); and
WHEREAS, Change Order #2 includes a change in the description of work to increase
quantities to perform emergency base repair work to Middlesex Avenue and to add
supplemental items to reflect as-built quantities; and
WHEREAS, Change Order # 2 provides for a net increase in the contract price in the
amount of $36,381.50 resulting in a revised contract price of $96,321.50, including all
previously approved Change Orders; and
WHEREAS, Change Order #2 results in an increase of more than 20% of the original
contract amount and the Borough's Consulting Engineer, T & M Associates, has certified
as to the emergent nature of the work performed and that the changes and/or
modifications to the project were unforeseen at the time of the award of the original
contract.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
1. That the Contract Change Order #2 attached hereto and made a part hereof,
resulting in a net decrease of $36,381.50 in the overall contract price, including
all previous Change Orders, resulting in a revised contract price of $96,321.50
is hereby approved.
2. That the appropriate Borough Officials are hereby authorized to execute Change
Order #2 based upon the recommendation of the Borough Engineer.
3. That the Borough Purchasing Department is hereby authorized to execute
payment pursuant to the Final Payment Certification No. 2 (See Attached).
4. A copy of this resolution and a fully executed copy of Change Order #2 be
forwarded to TAM Associates for distribution to DeFino Contracting Co..
