HomeMy Public PortalAbout1999_02_23_O004 Amending the Town Code regarding Prohibition on Through Truck Traffic The Town of Leesburg, _Virginia PRESENTED January 26, 1995 ORDINANCE NO. 99-0-04 ADOPTED February 23, 199t~ AN ORDINANCE: AMENDING SECTION 10-114 OF THE TOWN CODE PERTAINING TO CERTAIN THROUGH TRUCK TRAFFIC PROHIBITED WHEREAS, a public hearing to consider prohibiting certain through track traffic was held on September 8, 1998; and WHEREAS, one citizen spoke in favor of the proposed amendment; and WHEREAS, all VDOT requirements were followed, notification to the trucking industry was provided, proper signage was posted, and an origin and destination study of the downtown area was performed; and WHEREAS, the traffic study revealed there is a need to prohibit certain through truck traffic in the downtown area. THEREFORE ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 10-114 should be amended to read as follows: Section 10-114. Motortrucks prohibited upon streets of town except where specifically permitted r~.,..:.. ,~. ..... ~. · .... ~. ,....m .... ~.m:,~a (a) No motortruck shall be operated in the town upon the following streets or street intersections except when necessary for the purpose of receiving loads or making deliveries upon the following streets. Except.~ ....... v-.-...~:a~a t.~,u~v .... .., ..:* ~hall (1) King Street (Route 15 Business) between Battlefield Parkway and Catoctin Circle (2) Market Street (Route 7 Business) between Liberty Street and East Loudoun Street ORDINANCE: -2- PROHIBITING CERTAIN THROUGH TRUCK TRAFFIC (3) Loudoun Street between Dry Mill Road and East Market Street (4) Dry Mill Road between Catoctin Circle and Loudoun (5) Harrison Street between Catoctin Circle and East Market Street (6) Edwards Ferry Road between Plaza Street and East Market Street (b) The operation of a motortruck on any of the above-designated streets or street intersections shall be considered necessary for the purpose of receiving loads or making deliveries within the town only when the place of receipt or delivery may be accessed only by travel upon such street or street intersection and then only to the minimum extent that travel upon such street or street intersection is necessary for ingress-egress to the place of receipt or delivery. (c) For the purpose of this section, "motortruck" is defined as (1) every motor vehicle designed to transport property on its own structure independent of any other vehicle and having a registered gross weight in excess of seven thousand five hundred (7,500) pounds, and (2) every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the load and weight of any vehicle attached thereto. Paragraph (a) above does not apply to the following: (1) ~Jx~'~w~- ~ The operation of emergency vehicles upon any street or highway within the town; O3(2) The operation of motortrucks or vehicles owned or operated by the town, or agents of the town, public utilities, or motortrucks owned or operated by the Virginia Department of Highways and Transportation or its agents; (-4-)(3) The operation of motortrucks or vehicles upon any official established detour within the town; ORDINANCE: -3- PROHIBITING CERTAIN THROUGH TRUCK TRAFFIC SECTION II. All prior ordinances in conflict herewith are repealed. SECTION III. This ordinance shall be in effect upon its passage. PASSED this 23rd day of February, 1999. ATTEST: JMnes E.
