HomeMy Public PortalAbout1999_07_27_O022 The Town of Leesburg, _Virginia PRESENTED July 27, 1999 ORDINANCE NO. 99-0-22 ADOPTED July 27, 1999 AN ORDINANCE: APPROVING SPECIAL EXCEPTION APPLICATION #SE-99-03, GOODYEAR BUILDING EXPANSION, 314 EAST MARKET STREET WHEREAS, Hogan & Sons has requested special exception approval for expansion of a vehicle service facility on property located at 314 East Market Street; and WHEREAS, the property is located in the B-2, Established Corridor Commercial Zoning District; and WHEREAS, a vehicle service facility is a special exception use in the B-2 zoning district; and WHEREAS, on June 17, 1999, the Planning Commission recommended conditional approval of this application; and WHEREAS, on July 13, 1999, the Town Council held a public hearing; and WHEREAS, the proposed use meets the general review criteria as set forth in the Zoning Ordinance; and THEREFORE ORDAINED by the Town of Leesburg in Virginia as follows: SECTION I. Special exception application #SE-99-03, Goodyear building expansion, 314 East Market Street, by Hogan & Sons identified in the Loudoun County land records as Tax Map 48A((36))CM as shown on the Special Exception Plan prepared by Wolford & Chen, dated April 5, 1999 is hereby approved subject to the following conditions: 1. The existing oil storage tank shall be located on the concrete pad. 2. The proposed 22'X36' building addition shall be used for tire and accessory storage only. 3. A grading and drainage plan will be required prior to the issuance of a zoning permit. 4. All elements on the special exception plan are subject to change as necessary for conformance with the H-2 Corridor Design Guidelines, determined by the Board of Architectural Review. -2- SPECIAL EXCEPTION APPLICATION #SE-99-03, GOODYEAR BUILDING EXPANSION, 314 EAST MARKET STREET SECTION II. Approval of the special exception concept plan does not authorize modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance unless specifically set forth in this ordinance.
