PRESENTED: November 23, 2004 ADOPTED: November 23, 2004 AN ORDINANCE: AMENDING THE ZONING ORDINANCE ARTICLE 6 NONRESIDENTIAL DISTRICTS, ARTICLE 9 USE REGULATIONS AND ARTICLE 18 DEFINITIONS TO PERMIT A TEMPORARY COMMUTER PARKING LOT IN THE B-2 DISTRICT WHEREAS, the Town Council is supportive of providing transit alternatives to the citizens of Leesburg; and WHEREAS, it is the desire and intent of Town Council to consider the possibility of temporary commuter parking facilities in the Town of Leesburg; and WHEREAS, the Zoning Ordinance permits only permanent commuter parking lots in three districts; and WHEREAS, these amendments will provide enhanced parking opportunities to the citizens of Leesburg who participate in park and ride programs; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments; and WHEREAS, a Joint public hearing was held on November 23, 2004 between the Leesburg Town Council and the Planning Commission; and WHEREAS, the Planning Commission recommended approval of the zoning text amendments creating a temporary commuter parking lot use on November 23, 2004; and THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Leesburg Zoning Ordinance is hereby amended as follows: -2- AN ORDINANCE: AMENDING THE ZONING ORDINANCE ARTICLES 6, 9 AND 18 TO PERMIT A TEMPORARY COMMUTER PARKING LOT IN THE B-2 DISTRICT Sec. 6.4.2 B-2, Established Corridor Commercial Use Regulations B-2 Uses Use Use Standards Definition Institutional and Community Service Uses Temporary Commuter Parking S 9.3.23.1 Sec. Lot 18.1.175.1 Sec. 9.3 Use Standards 9.3.23.1 Temporary Commuter Parking Lot Because this parking facility is an interim use of limited duration which benefits the public the following standards shall apply: A. The temporary use may be exempt from otherwise applicable Zoning Ordinance standards to the extent Council determines such exemptions shall have no adverse impact on adjacent properties, except as provided below. B. The temporary commuter parking lot shall provide adequate circulation within the site and safe and convenient access onto adjoining streets. The circulation plan shall include stripping, number and location of entrances and travel aisles, provisions for the handicapped, and necessary traffic control improvements. Wheel stops must be provided for parking spaces on existing graveled areas. C. A plan must be provided which demonstrates safe and adequate lighting in accordance with the requirements of the Design and Construction Standards Manual. Article 18 Definitions 18.1.31 Commuter Parking Lot An off-street area surfaced and improved for parking, on a daily basis but not for the storage of vehicles for twenty four (24) hours or longer, established in conjunction with mass transit arrangements and car pooling programs. 18.1.175.1 Temporary Commuter Parking Lot An off-street surface facility used for parking of commuter vehicles on a daily basis, but not for the storage of such vehicles for twenty-four (24) hours or longer, established in conjunction with mass transit arrangements and car-pooling programs. A temporary facility is permitted for no longer than two (2) years at a particular site and shall not be renewable. A commuter parking lot intended to exist for more than two (2) years shall be considered a permanent Commuter Parking Lot as defined in Section 18.1.31 and must meet all current Zoning Ordinance and Subdivision and Land Development Regulations. -3- AN ORDINANCE: AMENDING THE ZONING ORDINANCE ARTICLES 6, 9 AND 18 TO PERMIT A TEMPORARY COMMUTER PARKING LOT IN THE B-2 DISTRICT SECTION II. Severability. If any portion of these amendments is declared invalid by a court of competent jurisdiction, the decision shall not affect the validity of amendments as a whole or any remaining provision of the Leesburg Zoning Ordinance.
