HomeMy Public PortalAbout2000_01_11_O002 TLSE 1999-06 Leesburg GreenThe Town of Leesburg, Virginia ORDINANCE NO. 2000-0-2 AN ORDINANCE: APPROVING SPECIAL LEESBURG GREEN, LOT WAREHOUSE FACILITY PRESENTED January 11, 2000 ADOPTED January 11, 2000 EXCEPTION APPLICATION #SE-99-06, 1 OF LEEGATE, TO PERMIT A MINI- WHEREAS, William M. Soltesz has requested special exception approval for a mini-warehouse facility; and WHEREAS, the property is located in the I-1, Industrial Research Park Zoning District; and WHEREAS, a mini-warehouse facility is a special exception use in the I-1 zoning district; and WHEREAS, on October 7, 1999, the Planning Commission recommended conditional approval of this application; and WHEREAS, on November 9, 1999, the Town Council held a public hearing; and WHEREAS, the proposed use meets the general review criteria as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE ORDAINED by the Town of Leesburg in Virginia as follows: SECTION I. Special exception application #SE-99-06, Leesburg Green, Lot 1 of Leegate, by William M. Soltesz, identified in the Loudoun County land records as MCPI# 198-29-8904 as shown on the Special Exception Plan, dated September 27, 1999, and any future version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: 1. Prior to approval of a final development plan, right of way across Lot 5 of Cardinal Industrial Park, will be dedicated to the town, at no cost to the town, pursuant to an obligation held by the owner of Lot 5 to dedicate this right-of-way to the Town, at no cost to the town. The applicant acknowledges that a final development plan shall not be approved until such dedication occurs. 2. Prior to approval of a final development plan, one-half the ultimate road section across Lot 5 of Cardinal Industrial Park will be constructed, at no cost to the town. -2- SPECIAL EXCEPTION APPLICATION #SE-99-06, LEESBURG GREEN, LOT 1 OF LEEGATE 3. Prior to approval of a final development plan, one-half of the ultimate right of way across Lot 1 of Leegate, will be dedicated to the town, at no cost to the town. Prior to approval of a final development plan, one-half the ultimate road section, in accordance with the Town Plan, across the entire width of Lot 1 of Leegate, will be constructed, at no cost to the town. 5. Prior to approval of a final development plan, a no access easement, extending the width of Lot 1 of Leegate along Route 7, will be dedicated to the town and VDOT as applicable. 6. Public water, for domestic use and fire protection, and public sewer must be extended to the site at no cost to the town. 7. Final site layout is subject to modification based on final engineering, including drainage, storm sewer, sanitary sewer, water lines and stormwater management. 8. Black wrought iron fencing shall be installed around the perimeter of the mini-warehouse facility, in locations identified by "--x--" on the special exception plan. 9. No equipment shall be located on the roof of any building. 10. The building mounted lighting, as shown on the special exception plan, is not approved as part of the special exception and will be subject to review and approval by the Board of Architectural Review and pursuant to Subdivision and Land Development Regulations. 11. All elements of the special exception plan are subject to change as necessary for conformance with the H-2 Corridor Design Guidelines, determined by the Board of Architectural Review. 12. The following language will be removed from the special exception plan, "Area to be conveyed to Parcel 2 via a boundary line adjustment" and that shaded area shall be labeled "Area not subject to the special exception application." 13. Any further development on Lot 1 of Leegate will require the submission of a development plan. 14. The landscaping requirements for the mini-warehouse facility shall be as shown on the special exception plan. The specific plant materials shall be subject to review and approval by the Town Arborist. Substitute plants may be necessary to ensure quality landscape design. 15. The mini-warehouse facility shall be located on Lot 1 of Leegate with a setback at least 375' from Route 7. 16. Prior to the approval of a final development plan, a utility easement, will be dedicated to the town. The easement shall be located along the entire width of Lot 1 of Leegate along Route 7, within the 100' building setback line and following the perimeter of the existing VDOT stormwater pond. -3- SPECIAL EXCEPTION APPLICATION #SE-99-06, LEESBURG GREEN, LOT 1 OF LEEGATE 17. The property owner of Lot 1 of Leegate shall coordinate the conversion of the existing sewage pump station on Lot 3 of Cardinal Industrial Park to a gravity sewer to run across Lot 1 of Leegate, with the property owner of Lot 3 of Cardinal Industrial Park. Both the applicant for this special exception application and the property owner of Lot 3 of Cardinal Industrial Park understand that this conversion shall be done at no cost to the Town or to the property owner of Lot 1 of Leegate. SECTION II. Approval of the special exception concept plan does not authorize modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance unless specifically set forth in this ordinance.
