HomeMy Public PortalAbout2000_02_08_O004 ZM 160 Loudoun County Public Schools The Town of Leesburg, Virginia PRESENTED February 8, 2000 ORDINANCE NO. 2000-0-04 ADOPTED February_ 8, 2000 AN ORDINANCE: APPROVING #ZM-160 LOUDOUN COUNTY PUBLIC SCHOOLS, CONCEPT PLAN AND PROFFER AMENDMENT WHEREAS, on November 17, 1999 the Town received #ZM-160 Loudoun County Public Schools concept plan and proffer amendment to amend the approved concept plan and proffers to permit a school maintenance facility on the property, show the location of a school maintenance facility on the property, and reduce the building restriction lines along the southern and eastern property lines; and WHEREAS, the Planning Commission held a public hearing on this application on December 16, 1999; and WHEREAS, on January 13, 2000, the Planning Commission recommended approval of this application subject to the proffers being revised in accordance with the Deputy Town Attorney's comments dated January 4, 2000; and WHEREAS, the Town Council held a public hearing on this application on February 8, 2000; and WHEREAS, the Proffers, dated November 17, 1999 and revised through January 18, 2000 (hereinafter referred to as Proffers) and Concept Plan amendment request are in the interest of the public necessity, convenience, general welfare, and good zoning practice. SECTION I. Rezoning application #ZM-160 Loudoun County Public Schools, Concept Plan and Proffer Amendment is hereby approved subject to the Proffers dated January 18, 2000, copies of which are attached hereto, and made a part hereof and incorporated by reference herein. -2- AN ORDINANCE: APPROVING #ZM-160 LOUDOUN COUNTY PUBLIC SCHOOLS, CONCEPT PLAN AND PROFFER AMENDMENT SECTION II. Concept plan approval does not express or imply any waiver or modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance except as specifically cited herein. Clem, Ma~or Town of Leesburg ATTEST: Cierk'of Co/uncil ~ Attached: Proffers attached hereto and incorporated by reference herein P:\OrdinanceXzm160 REQUESTED PROFFER AMENDMENT TO AMEND PROFFERS ORIGINALLY APPROVED AS PART OF REZONING APPLICATION #ZM-$8, AS AMENDED BY REZONING APPLICATION #ZM- 107 FOR APPROXIMATELY 7.08 ACRES OWNED BY THE COUNTY OF'LOUDOUN Pursuant to Section 15~2-2303 of the Code of Virginia (1950, as amended), and Section 13A-12 of the Zoning Ordinance of the Town of Leesburg in Virginia, the County of Loudoun, (the "Applicant"), the owner of Loudoun County Tax Map Parcel 60-8E (the "subject property") hereby proffers that development of the subject property shall be in accordance with the proffered Conditions approved as part ofrezoning application #ZM-S8 and as amended by rezonlng application #ZM-107 and as further amended hereby, if and only if this request is granted. These amended proffered conditions, if accepted amend the proffers for the subject property as follows: Proffer #14 0fofthe proffers for rezoning application #ZM-107 shall be amended as follows (underlined text indicates amendment): The principal uses for any future building on Parcel B2, .the subject property shall be limited to the following subject to the requirements and limitations of all applicable regulations and ordinances: Warehousing Commercial office building Public School Maintenance Facility- to be defined as the ...warehousing ofmalntenance m~terial for school buildings and provision ofworldng space for maintenance trades including .electrical; heating, ventilating, and air conditioning; plumbing. carpentry and lawn equipment maintenance. . The 45-foot building setback requirement set forth in Section I of the Proffers for rezonlng application #ZM-58 and as shown on the plat entitled "Plat to Accompany An Application to Amend Zoning Map" dated January 30, 1985 and prepared by Patton, Harris, Rust and Associates shall be amended to permit a 20-foot building setback requirement for the subject property. ITI. All other proffers not modified hereby shall remain in full force and effect These proffers are entered into voluntarily by the Applicant and shall apply to and be binding upon any and all successors-in-interest to the record owner of the subject property and are contingent upon approval from the Town Council of the rezonlng of the subject property APP ' CO By: ~
