HomeMy Public PortalAbout2000_03_14_O009 TLSE 2000-03 Holy Trinity ChurchThe Town of eesburg, irginia SUBSTITUTE ORDINANCE NO. __2000-0-09 PRESENTED April 25, 2000 ADOPTED April 25, 2000 AN ORDINANCE: APPROVING SPECIAL EXCEPTION APPLICATION #SE-2000-02, HOLY TRINITY LUTHERAN CHURCH, 605 WEST MARKET STREET, TO PERMIT A DAY CARE FACILITY WHEREAS, Holy Trinity Lutheran Church has requested special exception approval for a day care; and WHEREAS, the property is located in the R4, Single Family Residential Zoning District; and WHEREAS, a day care is a special exception use in the R4 zoning district; and WHEREAS, on April 6, 2000, the Planning Commission recommended conditional approval of this application; and WHEREAS, on April 25, 2000, the Town Council held a public hearing; and WHEREAS, the proposed use meets the general review criteria as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE ORDAINED by the Town of Leesburg in Virginia as follows: SECTION I. Special exception application #SE-2000-02, Holy Trinity Lutheran Church, is identified in the Loudoun County land records as Tax Map 48-45A as shown on the Special Exception Plan, dated February 17, 2000, and any future version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: 1. The proposed fence and any proposed signage shall be subject to review and approval by the Board of Architectural Review. 2. This special exception for a day care is valid at this location as long as Holy Trinity Lutheran Church continues to operate at this location. 3. Holy Trinity Lutheran Church shall comply with all state requirements for child care centers. -2- SPECIAL EXCEPTION APPLICATION SE-2000-02, HOLY TRINITY LUTHERAN CHURCH 4. The total day care enrollment shall not exceed 75 students. 5. The days and hours of operation for the day care shall be as follows: September -May, Monday - Friday, 8:45 a.m. to 3:00 p.m. SECTION II. Approval of the special exception concept plan does not authorize modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance unless specifically set forth in this ordinance.
