HomeMy Public PortalAbout2000_05_09_O011 TLSE 2000-03 Dale Lumber CompanyThe Town of eesburg, ¼irginia ORDINANCE NO. 2000-O-11 SUBSTITUTE PRESENTED May 9, 2000 DOPTED May 9, 2000 AN ORDINANCE: APPROVING SPECIAL EXCEPTION APPLICATION #SE-2000-03, DALE LUMBER COMPANY, CARDINAL INDUSTRIAL PARK, LOT P4 WHEREAS, Lawrence T. Dale has requested special exception approval for an outdoor storage area; and WHEREAS, the property is located in the I-1, Industrial Research Park Zoning District; and WHEREAS, an outdoor storage area is a special exception use in the I-1 zoning district; and WHEREAS, on April 20, 2000, the Planning Commission requested that staff put together a recommendation for conditional approval for their consideration at their May 4, 2000 meeting; and WHEREAS, on May 9, 2000, the Town Council held a public heating; and WHEREAS, staff recommends denial of this application because the proposed outdoor storage area is inconsistent with the use provisions of the Town Plan. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Special exception application #SE-2000-03, Dale Lumber Company, is identified in the Loudoun County land records as Tax Map 48((24))P4 as shown on the Special Exception Plan, dated February 24, 2000 is hereby approved subject to the following conditions: 1. The outdoor storage use shall be limited to a 7 year time period commencing the date of Town Council approval. 2. The property shall be inspected by the Town's Zoning Inspector every two (2) years to determine that the materials are being stored properly and safely and that the screening remains adequate to buffer the stored materials. 3. The landscaping shown on Exhibit A shall be installed by June 30, 2000. 4. The outdoor storage use shall be limited to the area labeled on the plans as "Proposed outdoor storage lot" -2- SPECIAL EXCEPTION APPLICATION SE-2000-03, DALE LUMBER COMPANY 5. Prior to commencement of the outdoor storage use on site, a grading and drainage plan must be submitted and approved. 6. No parking of vehicles shall be permitted on any graveled areas. 7. One "trailer" shall be used for the storage of archived paperwork only. This trailer shall be placed on the property in such a way that it is deemed a "structure that will qualify for a Loudoun County building permit" and shall be located on the site in the location shown on Exhibit B. 8. The sea containers shall not be stacked. The property shall not be used to store hazardous material, as defined in the American Society of Testing and Materials (ASTM) Standard Practice E1527-94 without first obtaining a permit from the appropriate Loudoun County departments. If such permit is issued, a copy shall be forwarded to the Town of Leesburg, Department of Planning, Zoning & Development, and such hazardous materials shall be restricted to those necessary and usual under any by right uses in the I-1 zoning district. SECTION II. Approval of the special exception concept plan does not authorize modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance unless specifically set forth in this ordinance. SECTION 111. This ordinance shall be in effect upon its passage. PASSED this 9th day of May, 2000. _,ta~es E.
