HomeMy Public PortalAbout2000_05_23_O016 Special Exception 2000-05 Voell EnterprisesThe Town of Leesburg, Virginia ORDINANCE NO. 2000-0-16 PRESENTED May 23, 2000 ADOPTED May 23, 2000 AN ORDINANCE: APPROVING SPECIAL EXCEPTION APPLICATION #SE-2000-05, VOELL ENTERPRISES, 21 CATOCTIN CIRCLE, TO PERMIT A VEHICLE SALES AND A VEHICLE SERVICE FACILITY WHEREAS, Voell Enterprises, Inc. has requested special exception approval for a vehicle sales and a vehicle service facility; and WHEREAS, the property is located in the B-2, Established Corridor Commercial Zoning District; and WHEREAS, a vehicle sales and a vehicle service facility are special exception uses in the B-2 zoning district; and WHEREAS, on May 4, 2000, the Planning Commission recommended conditional approval of this application; and WHEREAS, on May 23, 2000, the Town Council held a public hearing; and WHEREAS, the proposed use meets the general review criteria as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Special Exception application #SE-2000-05, Voell Enterprises, 21 Catoctin Circle, by Voell Enterprises, Inc., identified in the Loudoun County land records as Tax Map 48K((3))13 as shown on the Special Exception Plan, dated April 4, 2000, and any future version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: 1. An outdoor display area for motorcycles shall be provided for in the easternmost parking space along the front of the building facing Catoctin Circle. SPECIAL EXCEPTION APPLICATION SE-2000-05, VOELL ENTERPRISES, 21 CATOCTIN CIRCLE At the request of the Department of Engineering and Public Works, a temporary construction easement along the property line adjacent to Catoctin Circle shall be provided to the town, at no cost to the town. The exact location and size of such easement shall be determined by the Department of Engineering and Public Works. SECTION II. Approval of the special exception concept plan does not authorize modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance unless specifically set forth in this ordinance.
