Attests Mayor MARCH 19, 1951 The Council of Bal Harbour Village met at the Administration Building, Monday, March 19, 1951 at 8:00 O'clock P. M. There were present: Messrs. Beatt„ Simons and Stokely Absent: Messrs. Graham, Jr. and Whittaker Also present were Mr. W. H. Webb, Town Manager; Mary Wetterer, Town Clerk; and Fred Baisden, Town Attorney. In the absence of Mr. Graham, Jr., the vice -mayor Mr. Simons presided. The minutes of the previous meeting of February 27, 1951 were read and approved. Mr. Webb read to the council a proposed ordinance relating to village election procedure. The Council -discussed the adviseability of providing for an absentee ballot fot the coming election. Mr. Baisden explained that under'state`law municipalities may adopt the absentee ballot provisions, but the procedure was quite complicated and he believed that under conditions exisitng for Bal Harbour it was not necessary. The members then discussed the amount to be paid the election clerks. It was decided that for the election of May first the election clerks would be paid $10.00 each and the village would also furnish their lunch. MAROI' 19. 1951 70 On motion of Mr. Beatty, seconded by Mr. Stdkely, Ordinance No.23 entitled: "AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, SETTING FORTH ELECTION PROCEDURE. RELATING TO POSTED NOTICES; PROVIDING FOR PETITIONS FOR CANDIDATES; DETER- MINING VOTING HOURS; DESCRIBING THE -FORM OF BALLOT; APPOINTMENT OF ELECTION CLERKS." was unanimously adopted. The council then considered a letter written by Mr. W.V. Farrey asking that the village remove the trees from the parkway in front of his home under construction. Mr. Farrey sited that this was allowed in the Bey Point subdivision. Mr. Simons said that he had checked with the officials of Bay Point and trees could not be removed from their tree planting line, but could be shifted to allow for a driveway or walk. Mr. Stokely said he believed that inasmuch as all planting in Bal Harbour had been done in a harmonious manner the pattern should prevail. Mr. Beatty moved that the council would go on record that it was their decision that no trees would be removed from any of the Bal Harbour parkways, however, tress could be moved, when possible, to allow for a driveway entrance. Upon second by Mr. Stokely the motion .ias unanimously passed. Mr. Beatty said the council should appoint a planning board to pass on all houses to be constructed. Mr. Webb explained that under the deed restrictions Miami Beach Heights, Inc. would still have to pass on all plans. He read to the council the section of the village charter which provides for a zoning board of appeals and said that this board had been formed and that Mr. August Geiger, 15.r. Thomas Coogan, and Mr. Zurwelle had been appointed. Mr. Beatty moved that the mayor anoint a planning committee of three with the approval of the council. There was no section to this motion. After dis- cussion it was moved by Mr. Beatty, seconded b; Mr. Stokely, that the planning board would be reactivated or new members appointed at the next meetingand they would pass on all future plans for Bal Harbour construction before they were submitted to Miami Beach Heights, Inc. It was decided that the meeting next month would be held April 23rd instead of April 16th. Mr. Simons said that Mr. Barnes had written a letter to members of the council some months 2270 and that it had never been properly considered. He said that '.•he thought the members should know the exact status of the relations between the Florida Power and Light Company and Bal Harbour Village. Mr. Webb informed the council that Bal Harbour Village did not enter into the matter in any way as Miami Beach Heights still owned the system and all deal- ings were strictly between their officials and the Florida Power MARCH 19, 1951 71 and Light Company. Mr. Simons wanted to know if there wasn't some way the issue could be forced and the Florida Power and Light would have to buy the system. Mr. Webb suggested that the best solution was possibly to have a meeting with Mr. Graham, Sr. or each council— man to speak to him personally and see if things could be moved along a little faster.Mr. Simons asked that Mr. Whittaker be contacted and asked to bring the Florida Power and Light specificati.ons for our system to the next meeting. Mr. Simons wanted to know what the situation was with regard to Bal Harbour Village and the proposed commercial section. Mr. Webb explained that all the planning for this section was under the supervision of Mr. Harland Bartholomew and he tas sure that what— ever plan they decided upon would be for the best of the community. Upon motion of Mr. Beatty, seconded by Mr. Simons, the meet adjourned.
