AUTHORIZING STIPULATION OF
SETTLEMENT AND DISMISSAL
WHEREAS, on January 8, 2001, Mi,tchell Platt ("Petitioner") filed an appeal of, or, in
the alternative, request for remand of, the December 20, 2000 decision by the Division of
Selection Services, New Jersey Department of Personnel, upholding the removal of
Petitioner's name from the list of eligibles for the position of Police Officer (Certification
OL992313; Title of Police Officer; Symbol S9999A) in the Borough of Carteret; and
WHEREAS, in his appeal, filed with the Division of Merit System Practices and Labor
Relations, New Jersey Department of Personnel, Petitioner disputed the Borough's
request to remove his name from the list of eligibles for the position of Police Officer due
to an alleged "unsatisfactory background report;"and
WHEREAS, the Borough and Peitioner desire to settle this dispute amicably and to
avoid the time and expense of litigation; and
WHEREAS, the members of the Borough Council of Carteret are satisfied that
resolution of this matter pursuant to the terms of the attached Stipulation of Settlement
and Dismissal is in the best interest of the citizens and taxpayers of Carteret.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Clerk are
hereby authorized to execute the attached form of Stipulation of Settlement and Dismissal
on behalf of the Borough of Carteret and to take all appropriate and necessary action to
fulfill its terms and conditions.
Adopted this 5th day of April, 2001
and certified as a true copy of the
original on April 6, 2001.
