AMENDING SECTION 8A-8(1) OF THE ZONING
ORDINANCE, AND SECTION 13-75(C)(2) OF THE
SUBDIVISION AND LAND DEVELOPMENT REGULATIONS
TO RESTRICT THE USE OF A COMMON PARKING COURT
TO SERVE ONLY SINGLE-FAMILY ATTACHED
(TOWNHOUSE) DWELLING UNITS
WHEREAS, the Transportation Element of the 1997 Town Plan specifies that
"common parking courts" are not appropriate for single-family detached dwellings or
duplexes; and
WHEREAS, Road System Policy #10 of the 1997 Town Plan states that,
"Construction of private streets will be discouraged, however, private streets which serve
townhouse development will be considered"; and
WHEREAS, amendments to the Leesburg Zoning Ordinance and Subdivision and
Land Development Regulations that restrict the use of common parking courts to
townhouse development would be consistent with the 1997 Town Plan and would be in
the best interest of the public necessity, convenience, general welfare and good planning
practice:
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia
as follows:
SECTION I. Section 13-75(c) of the
Development Regulations is amended as follows:

Dwellings Abutting Common Parking Courts.

extend into a common parking court provided that:

Each approved common parking court shall serve no more than a total of
single-family attached dwelling lots.

AN ORDINANCE: AMENDING SECTION 8A-8(1) OF THE ZONING ORDINANCE
AND SECTION 13-75(C)(2) OF THE SUBDIVISION AND LAND DEVELOPMENT
REGULATIONS
SECTION II. Section 8A-8 of the Leesburg Zoning Ordinance is amended as
follows:
Section 8A-8. NUMBER OF OFF-STREET PARKING SPACES REQUIRED BY LAND
USE
(1)a. DWelling, Single Family Detached. 2.0 spaces per dwelling if access to the
lot is onto a public street; 2.5 spaces per dwelling if access to the lot is from
a private street, or common drive or ......... ~-: ....... ~
(1)c. Dwelling, Two-Family. 2.0 spaces per dwelling if access to the lot is onto a
public street; 2.5 spaces per dwelling if access to the lot is from a private
street, or common drive ~r ......... ~': ....... ~
SECTION III. This ordinance shall not apply to any existing or proposed subdivision
for which a preliminary subdivision plat was approved before the effective date of this
ordinance; provided, however, that the final plat for all sections of the subdivision, which
have not been recorded before the effective date of this ordinance, shall be recorded within
three years after the date of preliminary subdivision plat approval or within three years after
the effective date of this ordinance, whichever is later. Such subdivisions shall be governed
by the ordinances and regulations in effect when the preliminary subdivision plat was
approved and shall not be subject to the restrictions on nonconforming uses or structures by
virtue of their not conforming with current ordinances or regulations. Any redevelopment or
new construction not proposed on the approved preliminary subdivision plat shall be
governed by the then current ordinances and regulations.
SECTION IV. This ordinance shall be in effect upon its passage.
