SECTION 4E TO PERMIT A
MAJOR PUBLIC UTILITY BY SPECIAL EXCEPTION IN THE I-1
DISTRICT
WHEREAS, it is the desire and intent of Council to provide impact mitigation measures for
abutting land uses consistent with the policies of the 1997 Town Plan; and
WHEREAS, the Zoning Ordinance currently permits a major public utility as a by-right use
in the I-1 Industrial Research Park Zoning District; and
WHEREAS, the I-1 District adjoins residential districts where some major public utilities
are inappropriate without reasonable mitigation measures in accordance with the policies of the
1997 Town Plan; and
WHEREAS, the planning director and zoning administrator recommend adoption of these
amendments; and
WHEREAS, the public necessity, convenience, general welfare and good zoning practice
require the proposed amendments.
THEREFORE, ORDAINED by the Council of the Town Leesburg in Virginia as follows:
SECTION I. The Leesburg Zoning Ordinance is hereby amended as follows:

SECTION 1I. All prior ordinances in conflict herewith are hereby repealed.
SECTION m. Severability. If any provision of this ordinance is declared invalid by a court
of competent jurisdiction, the decision shall not affect the validity of the ordinance as a whole or
any remaining provisions of the zoning ordinance.
SECTION IV. This ordinance shall be in effect upon its passage.
