HomeMy Public PortalAbout2000_12_12_O036The Town of Leesburg, 'X'trg ma ORDINANCE NO. 2000-0-36 PRESENTED ADOPTED December 12, 2000 December 12, 2000 AN ORDINANCE: APPROVING SPECIAL EXCEPTION APPLICATION #SE 2000-10, 14 CARDINAL PARK DRIVE, TO PERMIT AN OUTDOOR STORAGE AREA. WHEREAS, VAMAC, Inc. has requested special exception approval for an outdoor storage area; and WHEREAS, the property is located in the I-l, Industrial Research Park Zoning District; and WHEREAS, on November 16, 2000, the Planning Commission recommended conditional approval of this application; and WHEREAS, on December 12, 2000, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a plumbing supply business as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE ORDAINED by the Town of Leesburg in Virginia as follows: SECTION I. Special Exception application #SE 2000-10, 14 Cardinal Park Drive, by VAMAC, Inc. identified in the Loudoun County Land records as MCPI# 189- 18-8631 as shown on the Special Exception Concept Plan, received on September 6, 2000, and any future version of the plan that incorporates the conditions contained herewith, is hereby approved subject to the following conditions: 1. The applicant or owner shall replace all missing or dead landscape material, as shown on the previously approved development plan, prior to occupancy of the premises by VMAC, Inc., a plumbing and heating distribution business. 2. The outdoor storage use shall be limited to the area labeled on the special exception concept plan as "Fenced Storage Yard". 3. The fence around the perimeter of the storage yard shall be a six-foot high vinyl coated chain link fence with privacy slats. 4. Prior to commencement of the outdoor storage use, a grading and drainage plan must be submitted and approved. 5. The stored materials shall not be stacked any higher than the height of the fence surrounding the storage yard. 6. The applicant agrees to remove any stored material that may be in conflict in areas where underground utilities are located upon proper notification by the Town for scheduled maintenance. Under emergency situations the applicant agrees that the Town may relocate the stored materials for the purpose of repairs or maintenance of the undergrOund utilities. 7. This special exception approval is limited for a storage yard to be used by VMAC, Inc. for outdoor storage associated with its plumbing and heating business. The fence shall be removed and the gravel yard shall be returned to a lawn surface should VMAC, Inc. vacate the premises. 8. The property shall not be used to store hazardous materials, as defined in the American Society of Testing and Materials (ASTM) Standard Practice E1527-94 without first obtaining a permit from the appropriate Loudoun County departments. If such a permit is issued, a copy shall be forwarded to the Town of Leesburg, Department of Planning, Zoning and Development, and such hazardous materials shall be restricted to those necessary and usual under any by right uses in the I-1 zoning district. SECTION II. Approval of the special exception concept plan does not authorize modifications to any requirements of the Design and Construction Standards Manual, Subdivision and Land Development Regulations or Zoning Ordinance unless specifically set forth in this ordinance.
