APPROVING SPECIAL EXCEPTION APPLICATION #SE
2000-11, JAFARI, TO PERMIT A VEHICLE SERVICE
FACILITY AND DENYING THE REQUEST FOR A VEHICLE
SALES FACILITY
WHEREAS, Mr. and Mrs. Iraj Jafari have requested special exception approval
for a vehicle service or vehicle sales facility; and
WHEREAS, the property is located in the B-2, Established Corridor Commercial
Zoning District; and
WHEREAS, on November 30, 2000, the Planning Commission recommended
denial of this application; and
WHEREAS, on January 9, 2001, the Town Council held a public heating; and
WHEREAS, the proposal meets the special exception standards for a vehicle
service facility; and
WHEREAS, staff recommends approval, with the conditions set forth below.
THEREFORE ORDAINED by the Town of Leesburg in Virginia as follows:
SECTION I. Special Exception application #SE 2000-11, Jafari, identified in the
Loudoun County Land records as MCPI# 189-45-4286 as shown on the Special
Exception Concept Plan for a vehicle service facility, received on January 2, 2001, and
any future version of the plan that incorporates the conditions contained herewith, is
hereby approved subject to the following conditions:
1. The development shall be in general conformance with the Special Exception
Concept Plan for a vehicle service facility received by the Town on January 2,
2001.
2. Approval of the special exception does not express or imply any waiver or
modification of the requirements set forth in the Subdivision and Land
Development Regulations, Zoning Ordinance, or the Design and Construction
Standards Manual. The dedication plat and development plan are subject to the
applicable Town regulations.
3. The development shall abide by the Town's special exception standards for a
vehicle service facility as set forth in section 11A-7(14) of the zoning ordinance.

4. A 10 feet wide right-of-way dedication (approximately 25 feet from the existing
centerline) shall be provided across the Sycolin Road frontage.
5. A CG-11 entrance and full frontage improvements with the curb line located
fifteen (15) feet from the Sycolin Road centerline (one half of a 30 feet wide
street) shall be provided.
6. A floodplain study and delineation must be prepared by a professional engineer
licensed to practice within the Commonwealth of Virginia and submitted with the
development plan application that confirms the limits of the 100-year floodplain
on the property. No portion of the proposed 5-bay service facility shall intrude
within the limits of the 100-year floodplain, and no fill will be placed within the
floodplain without prior approval by FEMA.
7. An arborist report prepared by a certified arborist will be submitted with the
development plan application if the applicant intends to use the existing tree lines
along the side and rear property boundaries to meet the buffer yard and screening
requirements. The report is to include tree preservation measures to protect the
existing tree lines during the construction period. Any gaps in the existing tree
lines are to be planted with the required S-2 screen or an evergreen hedge.
8. Street trees and shrubbery must be included on the landscape plan, as part of the
development plan submission, along the Sycolin Road frontage to improve the
facilities appearance from Sycolin Road.
9. The single-family detached structure shall not serve as a residence, but only as
supporting office space for the vehicle service or vehicle sales facility.
10. The vehicle service facility shall be subject to the conditions listed in the
information packet prepared by the applicant.
SECTION II. The request for a vehicle sales facility is hereby denied because a
vehicle sales facility is incompatible with the existing development pattern of the area.
SECTION llI. This ordinance shall be in effect upon its passage.
