AN ORDINANCE:
APPROVING SPECIAL EXCEPTION APPLICATION #SE
2000-12 STAR CONCRETE, TO PERMIT AN OUTDOOR
STORAGE AREA
WHEREAS, Star Concrete has requested special exception approval for an
outdoor storage area; and
WHEREAS, the property is located in the I-1, Industrial Research Park Zoning
District; and
WHEREAS, on December 21, 2000, the Planning Commission recommended
conditional approval of this application; and
WHEREAS, on January 23, 2001, the Town Council held a public heating; and
WHEREAS, the proposed use meets the special exception standards for a
concrete business as set forth in the Zoning Ordinance; and
WHEREAS, staff recommends approval, with the conditions set forth below.
THEREFORE, ORDAINED by the Town of Leesburg in Virginia as follows:
Special Exception application #SE 2000-12, Star Concrete identified in the Loudoun
County Land Records as Tax Map 48, Parcel 79 as shown on the Special Exception
Concept Plan, received on October 17, 2000 and any future version of the plan the
incorporates the conditions contained herewith, is hereby approved subject to the
following conditions:
1. Approval of the Special Exception does not express or imply any waiver or
modification of the requirements set forth in the Subdivision and Land
Development Regulations, Zoning Ordinance or the Design and Construction
Standards Manual. The development plan is subject to the applicable Town
regulations.

2. The proposed chain link fence around the perimeter of the storage yard shall
be an eight-foot high vinyl coated chain link fence with privacy slats.
3. The applicant will meet all the landscaping requirements outlined in Chapter 9
of the Zoning Ordinance.
4. The outdoor storage use shall be limited to .80 of an acre labeled on the
Special Exception plat "Outdoor Storage."
5. The stored materials shall not be stacked any higher than the height of the
fence surrounding the storage yard.
6. The Special Exception approval is limited for a storage yard to be used by Star
Concrete for outdoor storage associated with its concrete business. If Star
Concrete vacates the premises, they will remove all the materials and supplies
from the outdoor storage area.
7. The buffer area adjacent to the W&OD Trail will be expanded to a total of 31
feet instead of 25 feet as shown on the Special Exception plan. Plantings
within the buffer area must conform to Virginia Power's standards for
planting trees under power lines, and shall meet S-3 buffer requirements of the
Zoning Ordinance while the 25 foot buffer area adjacent to the VDOT
property has to meet the S-1 buffer requirement of the Zoning Ordinance.
8. Due to the requirement for a sight distance easement running in a
northeasterly direction along the site's frontage on Lawson Road, the
applicant will (a) need to move the chain link fence outside of the sight
distance easement, and (b) the area along Lawson Road outside of the sight
distance easement at a 25 foot buffer will be screened to the S-2 buffer
requirements of the Zoning Ordinance. The area within the sight distance
easement should be landscaped with low-level plantings of no more than 3.5
feet.
9. To the extent possible, the applicant should retain the existing trees in the
northeast comer of the property.

10. The property shall not be used to store hazardous materials, as defined in the
American Society of Testing and Materials (ASTM) Standard Practice E1527-
94 without first obtaining a permit from the appropriate Loudoun County
departments. If such a permit is issued, a copy shall be forwarded to the
Town of Leesburg, Department of Planning, Zoning and Development, and
such hazardous materials shall be restricted to those necessary and usual under
any by right uses in the I-1 zoning district.
11. All development on the site will be in conformance with the Special
Exception Plat dated October 12, 2000 and prepared by Dove and Associates.
SECTION I. This ordinance shall be in effect upon its passage.
