HomeMy Public PortalAbout2001_06_26_O008The Town of Leesburg, rg ma ORDINANCE NO.~- - ~ AN ORDINANCE: PRESENTED ~ ADOPTED ~ AMENDING ZONING ORDINANCE SECTIONS 5C AND ?40 TO REFERENCE THE LATEST FEMA FLOODPLAIN MAPS IN THE F-1 AND FHD ZONING DISTRICTS WHEREAS, it is the intent and desire of Council to continue participation in the National Flood Insurance Program administered by the Federal Emergency Management Agency (FEMA); and WHEREAS, FEMA has completed a new Flood Insurance Study and Flood Insurance Rate Maps for the Town of Leesburg; and WHEREAS, in order to comply with FEMA regulations, the F-1 Floodplain District and the FHD Flood Hazard District regulations in the Zoning Ordinance must be revised to reference the latest Flood Insurance Rate Maps for the Town; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments. THEREFORE, ORDAINED by the Council of the Town Leesburg in Virginia as follows: SECTION I. The Leesburg Zoning Ordinance is hereby amended as follows: Section 5C-6 DEIJNT. ATION OF F-1 lq DODPI.AIN DISTRICT The provisions of this Article shall apply to land in the town shown within the F-1 Floodplain District on the Zoning Map. The district shall include all the land area within the town which is within the 100-year floodplain for the Town Branch, Dry Mill Branch and Tuscarora Creek as identified in the National Flood ln.qnrance Prooram Flood Inmirance Rate Map.q for l.ondonn County: Virginia and Inca?orated Area.q; effective date July 5, 2001, ba.qed on the Flood Insurance Study for l.ondoun County: Virginia and lnco~orated Areas, pnhli.qhed By the Federal Emergency Management Agency (FEMA) effective date /nlg_5.,_20.~ the Towiiut · ................................................................... yi g ORDINANCE: -2- AMENDING ZONING ORDINANCE SECTIONS 5C REFERENCE THE LATEST FEMA FLOODPLAIN MAPS AND 740 TO Section 740.2 DF~TF~RMINATION OF RF. GI II ,ATOR Y 10(} YEAR FI DOD HATARD DISTRICTS. The Regulatory 100 Year Flood Hazard District (FHD) shall include all areas subject to inundation by the waters of the one hundred (100) year flood. SECTION Il. All prior ordinances in conflict herewith are hereby repealed. SECTION 111. Severability. If a court of competent jurisdiction declares any provision of this ordinance invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of the zoning ordinance.
