AN ORDINANCE:
AMENDING ZONING ORDINANCE SECTION 1 lA-4 TO REQUIRE A
PLANNING COMMISSION PUBLIC HEARING FOR SPECIAL
EXCEPTION APPLICATIONS
WHEREAS, it is the intent and desire of Council to provide the general public with the
fullest opportunity to comment on land use applications requiring legislative action; and
WHEREAS, existing Zoning Ordinance provisions do not require the Planning
Commission to hold a public hearing on special exception applications as part of the application
review process; and
WHEREAS, in order to provide the general public with additional opportunity to comment
on special exception applications, and to provide additional written notice to owners of property
adjacent to land subject to such an application, the special exception regulations in the Zoning
Ordinance must be revised to require a public hearing before the Planning Commission; and
WHEREAS, the public necessity, convenience, general welfare and good zoning practice
require the proposed amendments.
THEREFORE, ORDAINED by the Council of the Town Leesburg in Virginia as follows:
SECTION I. The Leesburg Zoning Ordinance is hereby amended as follows:

Planning Commission Puhlic Hearing and Recommendation. The Planning
Commission shall hold a public hearing on a proposed special exception in
accordance with the req.irements of ,qection 15_2-2204 of the 1 q~O Code of
Virginia; as amended. Thereafter: the Planning Commission shall forward the
proposed special exception to the Council, together with its recommendation(s)
and a statement fully setting forth its reasons for such recommendation(s) prior to

SECTION 11. All prior ordinances in conflict herewith are hereby repealed.
SECTION llI. Severability. If a court of competent jurisdiction declares any provision of
this ordinance invalid, the decision shall not affect the validity of the ordinance as a whole or any
remaining provisions of the zoning ordinance.
SECTION IV. This ordinance shall be in effect upon its passage.
