AMENDING THE LEESBURG
VARIOUS APPLICATION FEES

ZONING ORDINANCE REGARDING
WHEREAS, development review fees have not been reviewed since 1996 to determine the
appropriate charges for various plan reviews; and
WHEREAS, the Town Council in adopting the FY 2002 Budget agreed that the town staff
needed to review the existing development review fees and recommend appropriate changes; and
WHEREAS, the town staff discussed the fee changes with representatives of the development
community; and
WHEREAS, a development review fee analysis was completed by the town staff; and
WHEREAS, the findings are based on the following: 1) a comparison of the annual
expenditures the town has devoted to the review of development plans in the FY 2002 Budget in
relation to the amount of revenues collected annually from development review fees; and 2) a survey
of the development fees charged by several area jurisdictions; and
WHEREAS, amendments to the Zoning Ordinance are required by the public necessity,
convenience, general welfare and good zoning practice.
THEREFORE, ORDAINED by the Town Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The Zoning Ordinance shall be amended as shown below:
ARTICLE 6. PLANNED DEVELOPMENT REGULATIONS
Section 6A-5. GENERAL PROCEDURES
(2) Fees. Fees to be paid to the town for consideration of planned development petitions and
applications shall be as follows: (Amended 10/23/96)

a. Sketch plan review and comment, the fee shall be $500.00.
A petition for concept plan approval and amendment of the Town Plan, the fee shall be
$2,000.00.
An application for rezoning plan approval and establishment of a planned development
district, the fee shall be $2,000.00 $5,000.00 plus $100.00, per acre for PRN, PRC or
PEC districts.
An application for preliminary plat approval for all or part of a planned development,
the fee shall be $500.00 $2,000.00 plus $50.00 $100.00 per acre for PRN, PRC or PEC
districts.
Any concept plan ov and proffer amendment to an approved rezoning shall be
accompanied by the appropriate land development application and a fee of $2,999
$5,000, plus $!9 per acre. A proffer amendment only shall be accompanied by the
appropriate land development application and a fee of $2,000.
An application for preliminary development plan approval for all or part of a planned
development, the fee for first submissions shall be $2,000.00 plus $59.00 $100.00 per
acre. The fee for second and subsequent submissions shall be $600.00.
ARTICLE 11 - SPECIAL EXCEPTION REGULATIONS
Section 1 lA-4. APPLICATION, REVIEW, AND ENFORCEMENT PROCEDURES

Submission Requirements. All applications for special exception uses shall be accompanied by
the following items:
A review fee of $500.00 per accessory to a dwelling and $1,000.00 far al! zt.h~er special

ARTICLE 13 - AMENDMENTS
Section 13A-2. INITIATION OF AMENDMENTS
Amendments to the Zoning Ordinance shall be initiated only in the following manner:

Amendments to the zoning boundaries or classification of property shown on the Zoning Map
may be initiated by property owners of the land proposed to be rezoned, by the filling with the
Council of a Zoning Map amendment petition addressed to the Council, which petition shall be
on a standard form approved by the Planning Commission and provided by the Zoning

Administrator, and accompanied by a fee of $2,990.99 $5,000.00, plus $100 per acre, and other
material and data required in said form. Any Town Plan Amendment shall be accompanied by
the appropriate land development application and a fee of $2,000.00. Any concept plan o~ and

SECTION II: The ordinance shall take effect upon passage.
