AN ORDINANCE:
APPROVING REZONING ZM-2001-02 TAVISTOCK FARMS, TO AMEND
THE TAVISTOCK FARMS PROFFERS TO ALLOW ELEVATED DECKS
TO ENCROACH A MAXIMUM OF TEN (10) FEET INTO THE MINIMUM
REQUIRED REAR YARD SETBACK FOR ALL TOWNHOUSES.
WHEREAS, a proffer amendment application dated July 5, 2001 was received from Arcadia
Development Company requesting that the Tavistock Farms proffers be amended to allow unenclosed
elevated decks, three (3) feet above-grade or higher to encroach a maximum of ten (10) feet into the
minimum required rear yard setback for all townhouses; and
WHEREAS, on October 3, 2001, the Planning Commission held a public hearing after which the
Planning Commission voted 6-1 to recommend approval of Rezoning ZM 2001-02 Tavistock Farms; and
WHEREAS, on November 14, 2001, the Town Council held a public hearing to consider the
application; and
WHEREAS, staff recommends approval of ZM 2001-02.
THEREFORE RESOLVED by the Town Council of Leesburg in Virginia as follows:
Proffer 10 be added to the Tavistock Farms proffer statement as follows:
10. Deck Setback in Townhouse Sections. An unenclosed elevated deck, three (3) feet above-
grade or higher, can encroach a maximum of ten (10) feet into the minimum required rear yard
setback for all townhouses.
