AN ORDINANCE: PRESENTED February 26, 2002 2 0 0 2 - O- 2 ADOPTED February 26, 2002 AMENDING SECTION 11-32 OF THE TOWN CODE RELATING TO ENTERING OR REMAINING ON PROPERTY OF ANOTHER AFTER HAVING BEEN FORBIDDEN TO DO SO WHEREAS, the Town desires to continue to afford property owners throughout the town the ability to designate police officers of the Town of Leesburg as a person lawfully in charge of the property for purposes of banning persons without lawful business from the property and to be in compliance with the requirements of the State of Virginia Code 15.2 -1717.1, and WHEREAS, the Chief of Police supports this amendment to the existing ordinance in the interest of public safety. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Section 11-32 of the Town Code is amended by amending the title and adding a new subsection (b) to read as follows: 11-32. Entering or remaining on property of another after having been forbidden to do so; desiunation of police to enforce trespass violations. (b) Any owner of real property may, in writing on a form prescribed by the Chief of Police, designate the Police Department as a "person lawfully in charge thereof," as those terms are used in subsection (a) of this section, for the purpose of forbidding another to go or remain upon the lands, buildings or premises of such owner. Such designation shall include a description of the land(s), building(s) or premises to which it applies; shall reference the period of time during which it is in effect; and shall be kept on file in the office of the Chief of Police or in such other location within the Police Department as the Chief of Police deems appropriate. And the former section is renumbered as subsection (a). SECTION II.
