REJECTING THE ANNEXATION PETITION FILED BY THE OWNERS OF THE
DUNLYN PROPERTY
WHEREAS, Dunlyn LLC is the fee simple record owner of certain real property identified in the tax
year 2001 Loudoun County Tax Map 60 as Parcel 59 and 60 consisting of 329 acres of land located in Loudoun
County (hereinafter, the "Dunlyn Property"); and,
WHEREAS, Dunlyn LLC has filed a Notice with the Virginia Commission On Local Government of its
intent to intervene in the petition for annexation of unincorporated territory within Loudoun County, Virginia
into the Town of Leesburg now pending before the Commission and to seek annexation of the Dunlyn Property
into the Town; and,
WHEREAS, the Town Council has determined that the annexation of the Dunlyn Property would not be
in the best interests of the residents of the Town; and,
WHEREAS, Virginia Code § 15.2-3203(B) grants a town to which an annexation is proposed the
authority to reject such annexation by ordinance, duly adopted by a majority of the elected members of the
governing body of the town.
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows:
1.
The Town of Leesburg hereby rejects the proposed annexation of the Dunlyn Property to the Town
of Leesburg.
The Town Attorney and Special Legal Counsel are authorized to take all necessary steps to
communicate the Town Council's rejection of the proposed annexation of the Dunlyn Property to
the Commission on Local Government and to Dunlyn LLC.
Approved this 26th day of February_, 2002.
This Ordinance shall be in force and effect from the date of its passage.
