HomeMy Public PortalAbout2003_02_25_O002The Town of 1 .eesburg, lrglnla ORDINANCE NO: AN ORDINANCE: and PRESENTED February 25, 2003 2003-0-2 ADOPTED February 25, 2003 ADOPTING A COMPREHENSIVELY REVISED ZONING ORDINANCE AND REPEALING THE ZONING ORDINANCE OF 1990, AS AMENDED, EXCEPT FOR SECTIONS 5C AND 740 WHEREAS, the Leesburg Town Plan was amended and adopted in August 1997; WHEREAS, it is the desire and intent of Council to revise the Leesburg Zoning Ordinance to incorporate the recommendations of the Town Plan; and WHEREAS, an amendment to the Leesburg Zoning Ordinance to comprehensively revise the regulations and to incorporate the goals and policies of the 1997 Town Plan was initiated on November 24, 1999; and WHEREAS, on May 2, 2002 the Planning Commission held a public heating on these proposed amendments and forwarded the comprehensive revised zoning ordinance to the Town Council on June 6, 2002; and WHEREAS, the Town Council conducted a public heating on these comprehensive amendments on November 26, 2002; and WHEREAS, a comprehensive amendment to the zoning ordinance is necessary to better facilitate orderly development in Leesburg and implement the Town Plan land use policies; and WHEREAS, these comprehensive amendments to the zoning ordinance are recommended by the staff and are necessary to promote public safety and welfare, to -2- AN ORDINANCE: ADOPTING A COMPKEHENSWELY REVISED ZONING ORDINANCE AND REPEALING THE ZONING ORDINANCE OF 1990, AS AMENDED, EXCEPT FOR SECTIONS 5C AND 740 facilitate the creation of a convenient, attractive and harmonious community and to protect property values. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Leesburg Zoning Ordinance is hereby amended by the adoption of the following new articles entitled "Article 1: Review and Decision-Making Bodies, Article 3: Article 4: Zoning Districts (In General), Article 5: Introductory Provisions, Article 2: Review and Approval Procedures, Residential Zoning Districts, Article 6: Nonresidential Districts, Article 7: Overlay and Special Purpose Districts, Article 8: Planned Development Districts, Article 9: Use Regulations, Article 10: Density/Intensity + Dimensional Standards, Article 11: Parking, Loading and Pedestrian Access, Article 12: Landscaping, Screening, Open Space and Lighting, Article 15: Sign Regulations, Article 16: Nonconformities, Article 17: Enforcement and Penalties, and Article 18: Definitions" as contained in the text dated February 25, 2003. All articles and sections are hereby renumbered and re-codified as shown in the aforementioned text. SECTION II. The existing Leesburg Zoning Ordinance dated and adopted April 24, 1990 and its subsequent amendments are hereby repealed, except for Section 5C "F- l'' Floodplain District Regulations and Section 740 Regulatory 100 Year Flood Hazard District (FHD), which shall continue to govern floodplains in the Town of Leesburg. SECTION III. Severability. If any portion of these amendments is declared invalid by a court of competent jurisdiction, the decision shall not affect the validity of -3- AN 0RDINANCE: ADOPTING A COMPREHENSIVELY REVISED ZONING ORDINANCE AND REPEALING THE ZONING ORDINANCE OF 1990, AS AMENDED, EXCEPT FOR SECTIONS 5C AND 740 amendments as a whole or any remaining provision of the Leesburg Zoning Ordinance.
