APPROVING THE VACATION OF A PORTION OF NORTH ST., N.E.
WHEREAS, the town requires 131 square feet of private property belonging to DAVID
L. and HOLLI D. BOWERS in order to secure the necessary right-of-way to construct a public
sidewalk on the south side of North Street, N.E.; and
WHEREAS, DAVID L. and HOLLI D. BOWERS have requested that the town make an
exchange of existing town property of 149 square feet for the Bowers property of 131 square feet;
and
WHEREAS, both parties agree to said exchange in lieu of monetary consideration from
the Town; and
WHEREAS, the Town has agreed to vacate an existing portion of town land consisting of
149 square feet of public street, found on the Plat Showing Street Dedication and Vacation and
Various Easements on the Lands of David L. & Holli D. Bowers, File #L231.031.D, recorded on
October 12, 1999 and last revised May 29, 2001; and
WHEREAS, a public hearing, as required pursuant to Section 15.2-2006 of the 1950
Code of Virginia as amended, was held on Tuesday, July 22, 2003 at 7:30 p.m., in the Council
Chambers of the Government Center at 25 West Market Street, Leesburg, Virginia 20176, and no
speakers came forward. Notification was published in the Leesburg Today in accordance with
established advertising requirements.

THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as
follows:
The town hereby vacates a portion of North St., N.E., consisting of 149 square feet of
public street, as shown on the Plat Showing Street Dedication and Vacation and Various
Easements on the Lands of David L. & Holli D. Bowers, File #L231.031.D, recorded on October
12, 1999 and last revised May 29, 2001
