AN ORDINANCE: PRESENTED October 15, 2003 2 0 0 3 - o- 1 6 ADOPTED October 15, 2003 APPROVING PROPOSED REVISIONS TO REGULATIONS FOR USE OF PARKS, TOWN CODE OF LEESBURG, VIRGINIA, ARTICLE V, SECTION 11-81. WHEREAS, the Town Council adopted the Regulations for Use of Parks in February 1992 per Town Ordinance 91-0-11 and 95-0-29 as a part of the Town Code of Leesburg, Article V, Section 11-81; and WHEREAS, in March 2003, the Governor of Virginia signed legislation passed by the Virginia General Assembly regarding the control and carry of concealed weapons in public parks by state-approved permit holders; and WHEREAS, this legislation became effective July 1, 2003 and supercedes the town's current ordinance that bans the carrying of weapons in town parks; and WHEREAS, as a result of the new legislation, the department of parks and recreation began a comprehensive review of the entire ordinance; and WHEREAS, the recommended changes have been endorsed by the Parks and Recreation Advisory Commission; and WHEREAS, the Director of Parks and Recreation recommends that the Town Council approve the proposed revisions. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Regulations for Use of Parks, Town Code of Leesburg, Virginia, Article V, Section 11-81 be revised as follows: SECTION I. The Town Code of Leesburg, Virginia, ARTICLE V. PUBLIC PARKS, Sec. 11-81. Regulations for use of parks be amended as follows: AN ORDINANCE: -2- APPROVING PROPOSED REVISIONS TO REGULATIONS FOR USE OF PARKS (b) Park property. No person in a park shall: (1) Property: bo Restrooms and washrooms. Fail to cooperate in maintaining restrooms and washrooms in as neat and sanitary condition as prior to personal use, nor shall any person over the age of si-x-(6-) five (5) years use the restrooms and washrooms designated for the opposite sex. (d) Traffic. No person in a park shall: (8) Parking. bo Prohibited activities. Park a vehicle in a park for the expressed purpose of washing, repairing, or maintaining the same. Overnight parking not permitted without prior written authorization from the Director. Tractor trailers, campers, RV vehicles, boats/iet skis and related trailers, and over-sized vehicles are not permitted in parking areas at any time without prior written authorization from the Director. (10) Skateboard, rollerskates, etc. Confined to specific areas. Ride a skateboard, o~ rollerskate, or rollerblade, etc. on or in an area not designated specifically for skateboarding, ov rollerskating, or rollerblading. Skateboarding, rollerskating, and/or rollerblading permitted on paved trails. (e) Prohibited uses ofparks. No person in a park shall: (5) Hunting and firearms. Hunt, trap or pursue wildlife at any time. No person shall within a park use, carry, or possess firearms of any description, unless he or she is the authorized holder of a valid Commonwealth of Virginia Concealed Weapons Permit. Such a permit must be on their person when carrying any concealed weapon within the boundaries of any town park. No person within a park shall carry or possess ov air rifles, spring guns, bow and arrows, slings, or any other forms of weapons potentially dangerous to wildlife and to human safety or any instrument that can be loaded with and fire blank cartridges, or any kind of trapping device. Discharging firearms into park areas from beyond park property boundaries is forbidden (6) Picnic areas and use. ............ v ......................... e .............. v".v .... Park attendants shall have the authority to regulate picnic activities in such areas when necessary to prevent congestion and to secure the maximum use for the comfort and convenience of all. Visitors shall comply with any directions given by park attendants to achieve this end. AN ORDINANCE: -3- : APPROVING PROPOSED REVISIONS TO REGULATIONS FOR USE OF PARKS (g) Behavior. No person in a park shall: (11) Weapons. Have in or on their possession any weapon of any type unless he or she is the authorized holder of a valid Commonwealth of Virginia Concealed Weapons Permit. Such a permit must be on their person when carrying any concealed weapon within the boundaries of any park. (h) Park operating policy. (2) Hours. Parks shall be open to the public every day of the year from ~:.nn,,.,,,,......A s,~ +^~,~ ~.,..,~,.n,nn P.M. dawn to dusk, except park facilities with special hours of operation which shall be posted thereon. Special permission from the Director is required for any person to remain in any park area outside regular hours. (i) Penalties. (1) Violation of any provision of Section 11.81 shall be punished by ejectment from the park and a fine of not more than,~,,,,,.,,,,,et nc~ rm $200.00 either or both. SECTION II. All prior ordinances in conflict herewith are repealed. SECTION III. Severability. If a court of competent jurisdiction declares any portion of this ordinance as invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of the parks regulations ordinance.
