AN ORDINANCE: PRESENTED October 15, 2003 2003-0-17 ADOPTED October 15, 2003 AMENDING THE PERSONNEL MANUAL, SECTION 12. l- 102 WHEREAS, the Town Council recommends amending the Personnel Manual. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: Section I. Section 12-1.102. Disclosure of Violations (a) Reprisal Prohibited. Neither the Town of Leesburg shall net nor the Town Council shall engage in reprisal against an employee for disclosing a violation or suspected violation of a local, state, or federal law. This prohibition against reprisal shall protect both Town employees and contract employees of the Town Council in cases where the aforementioned disclosure is made either to another employee of the Town or to a contract employee of the Town Council or to a member of the Town Council or to law enforcement authorities, including, but not limited to, any federal law. enforcement agencies, the offices of the Virginia State Police, the office of Commonwealth's Attorney, the office of the Sheriff of Loudoun County, the Leesburg Police Department, or the public or members of the media (b) Application An employee of the Town of Leesburg or contract employee of the Leesburg Town Council who reports or have has indicated an intent to report, such violation or suspected violations shall be protected by this rule, unless the employee, or contract employee of the Town Council, knew the report was false. This protection shall extend to employees, or contract employees of the Town Council, who participate, or who were known by the Town of Leesburg or the Leesburg Town Council to have indicated an intent to participate, in an investigation, hearing or inquiry conducted by a public body or by any law enforcement agency, ~.a · .... ~ ......... ~'~ ~"~;~"*~' or who were known by the Town of Leesburg or Leesburg Town Council to have indicated an intent to participate in a court proceeding. AN ORDINANCE: -2- AMENDING THE PERSONNEL MANUAL, SECTION 12.1-102 Employees of the Town of Leesburg and contract employees of the Town of Leesburg are encouraged to make timely, good-faith reports of violations or suspected violations of local, state or federal criminal laws directly to the Office of the Commonwealth's Attorney or other local, state or federal law enforcement agencies. (c) Forms of Reprisal Reprisal includes such actions as discharge, threats of discipline or arbitrary and capricious changes in the conditions of employment. Section II.
