HomeMy Public PortalAbout18-01 PERMITTED USES AND DEVELOPMENT STANDARDS, STORAGE AND SALVAGE MAXIMUM HEIGHT 1st Reading: February 28,2018 2"d Reading March 28, 2018 Public Hearings: February 28,2018 &March 28, 2018 Adopted: March 28, 2018 Effective Date: March 28, 2018 Sponsor: Commissioner J.Riley ORDINANCE NO. 18-01 AN ORDINANCE OF THE CITY COMMISSION OF OPA-LOCKA, FLORIDA, AMENDING THE OPA-LOCKA CODE OF ORDINANCES, CHAPTER 22 ZONING; ARTICLE IV DISTRICTS - PERMITTED USES AND DEVELOPMENT STANDARDS, SEC. 22-94. - I-4 LIBERAL INDUSTRIAL DISTRICT, STORAGE AND SALVAGE, MAXIMUM HEIGHT; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR ADOPTION OF ARTICLE; PROVIDING FOR AUTHORITY; PROVIDING FOR CODIFICATION; PROVIDING FOR SCRIVENER'S ERRORS; PROVIDING FOR CONFLICT; PROVIDING FOR LIBERAL CONSTRUCTION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, the Opa-Locka Code of Ordinances sets forth requirements for walls surrounding stacked automobiles and automobile parts; and WHEREAS, the Commission of the City of Opa-Locka, Florida has determined that the following amendment to the City's Land Development Regulations (LDR) will be in the best interest of the City of Opa-Locka; and WHEREAS, the Commission of the City of Opa-Locka, Florida desires to enact an ordinance amending Chapter 22 Zoning; Ordinance 15-31, Article IV Districts - Permitted Uses and Development Standards, Sec. 22-94. - I-4 Liberal Industrial District, Storage and Salvage, Maximum Height of the City of Opa-Locka Code of Ordinances. NOW THEREFORE,BE IT ORDAINED BY THE COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: SECTION 1. RECITALS. The above recitals are true and correct and incorporated herein as though fully set forth below. SECTION 2. TITLE. The provisions of this Section titled "Maximum Height" shall be amended. Ordinance No. 18-01 SECTION 3. AMENDING CHAPTER 22 ZONING; ORDINANCE 15-31, ARTICLE IV DISTRICTS - PERMITTED USES AND DEVELOPMENT STANDARDS, SEC. 22-94. - I-4 LIBERAL INDUSTRIAL DISTRICT, STORAGE AND SALVAGE, MAXIMUM HEIGHT 1 story or 20 feet, whichever is less. The stacked height of automobiles or automobile parts shall - is at least six (6) feet high as high as the stacked automobiles; in no event shall automobiles or automobile parts, as stored, piled or placed, exceed the requirements herein. All material, supplies, automobiles, automobile parts, or other items shall be hundred (300) feet horizontally from all directions. be allowed beyond the minimum wall height of six (6) feet but shall not be visible to a person standing in the right of way, adjacent to the property (on the sidewalk). The wall height reduction, to a minimum height of six (6) feet, is only permitted in the I-4 zoning district and not in any other zoning district where similar uses allowing the stacking of vehicles or vehicle parts above the height of the wall have been grandfathered in. SECTION 5. CODIFICATION. It is hereby the intention of the Commission of the City of Opa-Locka and it is hereby provided that the provisions of this Ordinance may become and be made a part of the Code of Opa-Locka, Florida. SECTION 6. SCRIVENER'S ERRORS. Sections of this Ordinance may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected or re-codified copy of same with the City Clerk. SECTION 7. CONFLICT. Any provision of any City of Opa-Locka ordinance or regulation which is in conflict with the provisions of this Ordinance is repealed prospectively to the extent of such conflict. SECTION 8. LIBERAL CONSTRUCTION. The terms and provisions of this Ordinance shall be liberally construed to affect the purpose for which it is adopted. SECTION 9. SEVERABILITY. If any portion of this Ordinance is for any reason held or declared to be unconstitutional, invalid or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance shall be held to be inapplicable to any person, Ordinance No. 18-01 property or circumstances, such holding shall not affect the applicability of this Ordinance to any other person,property or circumstances. SECTION 10. EFFECTIVE DATE. This Ordinance shall take effect immediately upon the adoption and subject to the approval of the Governor of his designee. This ordinance was moved for adoption by Commissioner Riley. The motion was seconded by Vice Mayor Kelley, and upon being put to a vote, the motion passed by a 3-1 vote: Commissioner Holmes NOT PRESENT Commissioner Pigatt NO Commissioner Riley YES Vice Mayor Kelley YES Mayor Taylor YES PASSED AND ADOPTED this 28th day of March, 2018. Districts, Permitted Uses and Development Standards Sec. 22-94. 1-4 Liberal Industrial District, Storage and Salvage This Industrial District provides for the below stated uses at appropriate locations. 1. Table of Standards Standard 1-4 Intensity .75 Floor Area Ratio Minimum Site Area One acre Setbacks Front— 15 feet Side with a public alley -7 feet Side—0 feet Rear— 15 feet 50 feet from any residential district, with at least a 30 foot landscaped buffer Maximum Height 1 story or 20 feet, whichever is less The maximum stacked height of automobiles or automobile parts shall not exceed fifteen (15) feet, and bust be enclosed by a wall which is at least as high as the stacked automobiles; in no event shall automobiles or automobile parts, as stored, piled or placed, exceed the requirements herein.
