ORDINANCE NO. 18-02
AN ORDINANCE OF THE CITY COMMISSION OF OPA-LOCKA,
FLORIDA, AMENDING ORDINANCE 15-25 THAT GOVERNS THE
PREPARATION OF AGENDAS FOR CITY COMMISSION MEETINGS;
PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR
ADOPTION OF ARTICLE; PROVIDING FOR AUTHORITY;
PROVIDING FOR CODIFICATION; PROVIDING FOR SCRIVENER'S
ERRORS; PROVIDING FOR CONFLICT; PROVIDING FOR LIBERAL
CONSTRUCTION; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR EFFECTIVE DATE.
WHEREAS, On October 1, 2015, the City Commission adopted Ordinance 15-25 that
implemented procedures for the preparation of agendas; and
WHEREAS, due to the limited preparation time afforded to City Staff, many agenda
items are not thoroughly researched or properly presented; and
WHEREAS, the Commission of the City of Opa-Locka, Florida desires to enact an
ordinance amending Ordinance 15-25 City of Opa-Locka Code of Ordinances.
NOW THEREFORE,BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA AS FOLLOWS:
SECTION 1. RECITALS.
The above recitals are true and correct and incorporated herein as though fully set forth
below.
SECTION 2. TITLE.
The provisions of this Section titled "Agenda" shall be amended.
SECTION 3.AMENDING ORDINANCE 15-25.
I. All requests for placement of items on a City Commission
Agenda by the Mayor, Commissioners, Department Heads and
any other party must be submitted to the City Manager for fiscal

impact analyses, by no later than 12:00 p.m. on the Monday, one
week twelve (12) business days prior to the regularly scheduled
commission meeting;
2. The City Manager shall serve as a central repository of the items,
prepare any financial impact statements and forward all requests for
legislation to the City Attorney no later than 5:00 pm on the
Monday, nine (9) business days before the Agenda is printed and
disseminated;
3. The City Attorney shall prepare all legislative items; approve all
items for legal sufficiency and submit the completed items to the
Clerk' s office no later than 12:00 pm on the Wednesday,
Monday, four (4) business days before the Agenda is
disseminated;
4. All Agenda requests shall be submitted in writing, explaining
specifically the requested legislation and include all back-up
materials;
5. The Clerk is required to time stamp any items not submitted
electronically and shall not accept any items passed the deadline
for inclusion on the upcoming Agenda, but shall place untimely item
on the next Agenda;
6. Emergency items must be submitted by noon on the Tuesday before
the Commission meeting, but only if the requesting party certifies
the Item to be an emergency affecting life, health, property, or the
financial stability of the City; and if the Commission concurs at the
Meeting;
7. These procedures shall supersede any prior legislation on this topic.
SECTION 5. CODIFICATION.
It is hereby the intention of the Commission of the City of Opa-Locka and it is hereby
provided that the provisions of this Ordinance may become and be made a part of the
Code of Opa-Locka, Florida.
SECTION 6. SCRIVENER'S ERRORS.
Sections of this Ordinance may be renumbered or re-lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Ordinance No. 18-02
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected or re-codified copy of same with the City Clerk.
SECTION 7. CONFLICT.
Any provision of any City of Opa-Locka ordinance or regulation which is in conflict
with the provisions of this Ordinance is repealed prospectively to the extent of such
conflict.
SECTION 8. LIBERAL CONSTRUCTION.
The terms and provisions of this Ordinance shall be liberally construed to affect the
purpose for which it is adopted.
SECTION 9. SEVERABILITY.
If any portion of this Ordinance is for any reason held or declared to be
unconstitutional, invalid or void, such holding shall not affect the remaining portions
of this Ordinance. If this Ordinance shall be held to be inapplicable to any person,
property or circumstances, such holding shall not affect the applicability of this
Ordinance to any other person,property or circumstances.
SECTION 10. EFFECTIVE DATE.
This Ordinance shall take effect immediately upon the adoption and subject to the
approval of the Governor of his designee.
This ordinance was moved for adoption by Vice Mayor Kelley. The motion was seconded by
Commissioner Pigatt, and upon being put to a vote, the motion passed by a 4-1 vote:

ORDINANCE NO. 15-25
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF OPA-LOCKA, FLORIDA ESTABLISHING PROCEDURES
FOR AGENDA PREPARATION; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR
CONFLICT AND REPEALER; PROVIDING FOR
• SEVERABILITY AND CODIFICATION; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City Commission of the City of Opa-locka desires to have Agenda
preparation procedures that are efficient and best serve the public interest; and
WHEREAS, the City Commission believes that amending the current procedures and
adopting the procedures contained herein will provide for a smoother and more efficient process;and
WHEREAS, the City of Opa-locka Charter provides the Commission the authority to set
forth its rules of procedure;and
WHEREAS,the City of Opa-locka conducted a workshop on Agenda Procedures.
NOW, THEREFORE, BE IT DULY ORDAINED BY THE CITY
COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA:
Section 1. The recitals to the preamble herein are incorporated by reference.
Section 2. The following procedures will govern the preparation of agendas for
the City Commission Meetings commencing with the Agenda for the first
Commission meeting in October, 2015:
1. All requests for placement of items on a City Commission Agenda by the Mayor,
Commissioners, Department Heads and any other party must be submitted to the
Ordinance No. 15-25

Section 3. All ordinances or Code provisions in conflict herewith are hereby repealed.
Section 4. If any section, subsection,sentence,clause,phrase or portion of this Ordinance
is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and such holding shall not
affect the validity of the remaining portions of this Ordinance.
Section 5. CODIFICATION. This Ordinance shall be codified in the Code of Ordinances
when the code is recodified.
Section 6. EFFECTIVE DATE. This Ordinance shall upon adoption, become effective
immediately.
