REMOVING CLASS IV MEMBER FROM
THE CARTERET PLANNING BOARD
WHEREAS, on February 6, 2004, the Borough Council initiated the following charges
against Class IV Carteret Planning Board Member Jean Dato:
1. Misconduct
2. Improper/Inappropriate Conduct
3. Conduct Unbecoming a Municipal Official
Specifications:
On or about January 28, 2004, you did express improper and inappropriate
comments of a derogatory and offensive nature toward certain national, ethnic and
socio-economic groups in relation to an application that was before the Carteret
Planning Board and reasonably likely to be perceived by the public as improperly
influencing your decision and input on that application and future applications
that may come before the Board.
; and
WHEREAS, on February 19, 2004; the Borough Council conducted a public hearing
with reference to the above charges, as requested by Ms. Dato; and
WHEREAS, at said hearing, testimony was received from Planning Board Members
Jorge Diaz, Donald Black and Chester Bohanek, and correspondence fi.om certain of said
members to the Borough Council, which formed the basis for the lodging of the above
referenced charges against Ms. Dato, was reviewed; and
WHEREAS, Ms. Dato was represented by legal counsel at said hearing, during which
counsel for Ms. Dato was afforded the opportunity to question the above referenced
witnesses and to otherwise present a defense to the charges; and
WHEREAS, the Borough Council duly considered the testimony and evidence presented
at the hearing, as well as the arguments made by Ms. Dato's legal counsel.
NOW, THEREFORE BE IT RESOLVED by the Borough Council of the Borough of
Carteret, County of Middlesex, State of New Jersey that the charges against Ms. Dato, as
detailed above, are hereby sustained and, accordingly, Ms. Dato is hereby removed as a
Class 1V Member of the Carteret Plarming Board.
BE IT FURTHER RESOLVED that a copy of this Resolution be forw'arded to the
Carteret Planning Board and to Ms. Dato via registered mail.
