AN ORDINANCE: PRESENTED September 28, 2004 ADOPTED September 28, 2004 AMENDING CHAPTER 10 OF THE LEESBURG TOWN CODE TO INCLUDE SECTION 10-134 INCREASING THE PENALTY FOR SPEEDING ON NORTH KING STREET BETWEEN NORTH STREET AND OAKCREST MANOR DRIVE WHEREAS, residents in the 200 to 500 block of North King Street have expressed concern regarding speeding on this section of road between North Street and Oakcrest Manor Drive; and WHEREAS, ninety-seven percent (97%) of the affected residents have signed a petition in support of an increased penalty of $200.00 for speeding on North King Street between North Street and Oakcrest Manor Drive; and WHEREAS, the town's Traffic Engineering Division and the Leesburg Police Department have documented speeding in this area; and WHEREAS, the Leesburg Standing Residential Traffic Committee voted unanimously to recommend the request for imposition of the additional $200.00 penalty for speeding on North King Street; and WHEREAS, Section 46.2-878.2 of the State Code allows local governing bodies to impose a fine in addition to other penalties prescribed by law in certain residential districts; and WHEREAS, Council desires to help enhance neighborhood quality of life; and WHEREAS, the Town Attorney reviewed a vicinity map to determine the affected residential zone; and AN ORDINANCE: -2- AMENDING CHAPTER 10 OF THE LEESBURG TOWN CODE TO INCLUDE SECTION 10-134 INCREASING THE PENALTY FOR SPEEDING ON NORTH KING STREET BETWEEN NORTH STREET AND OAKCREST MANOR DRIVE WHEREAS, the Director of Engineering and Public Works recommends an increased penalty of $200.00 for speeding on North King Street between North Street and Oakcrest Manor Drive. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Sec. 10-134. Increase the penalty for speeding on North King Street Pursuant to Section 46.2-878.2 of the Code of Virginia, any person who operates a motor vehicle in excess of the maximum speed limit established for the roadways listed below in residential neighborhoods, on or after the effective date shall be guilty of a traffic infraction punishable by a fine of two hundred dollars ($200.00), in addition to other penalties provided by law. 1. North King Street (Business 15) from North Street to Oakcrest Manor Drive. SECTION II. This ordinance shall be effect upon its passage. SECTION III. All prior ordinances and resolutions in conflict herewith are repealed. PASSED this 28th day of September 2004. Kristen C.
