HomeMy Public PortalAbout2005_09_13_O015 The Town of Leesburg, Virginia PRESENTED: September 13.2005 ORDINANCE NO. 2005-0-15 ADOPTED: September 13.2005 AN ORDINANCE: REVISING THE COMPREHENSIVE TOWN PLAN FOR THE TOWN OF LEESBURG WHEREAS, Section 15.2-2223 of the Code ofVirginia provides for the periodic review of adopted comprehensive plans; and WHEREAS, consistent with the Town's ongoing obligation to review its comprehensive plan ("the Town Plan"), the Town's Planning Commission, with the assistance of the Town's Department of Planning, Zoning and Development, reviewed the 1997 Town Plan for Leesburg; and WHEREAS, based upon its review and consideration of public comments at its public hearing and work sessions, written comments submitted by the public, background reports, and comments from Town staffand other Town commissions, on June 23, 2005, the Leesburg Planning Commission by resolution 2005-01 certified and recommended to the Town Council that it amend the Town Plan and adopt as the 2005 Town Plan the text and map provisions set forth in the document entitled "May 13, 2005, Revised Draft Town Plan," including the revisions stated in that resolution; and WHEREAS, on June 23, 2005, the Leesburg Planning Commission by resolution 2005-01 recommended that the Town Council also endorse the action programs and transportation cost data set forth in Appendices A and B to the document entitled "May 13,2005, Revised Draft Town Plan," which were attached to but not incorporated into that document; and WHEREAS, the Town Council held a public hearing on July 26, 2005, after notice in accordance with Section 15.2-2204 of the Code ofVirginia, at which numerous public speakers and members ofthe Town's staffpresented testimony regarding amendments to the Town Plan, and these -2- AN ORDINANCE: REVISING THE COMPREHENSIVE TOWN PLAN FOR THE TOWN OF LEESBURG comments were carefully considered by the Council; and WHEREAS, the Town Council held a meeting on June 27, 2005, as weil as work sessions on August 8, 2005, September 6,2005, and September 12, at which amendments to the Town Plan were addressed, carefully considered, discussed, and debated; and WHEREAS, the Town Council also received numerous comments in writing from members of the public regarding amendments to the Town Plan, and these comments were carefully considered by the Council; and WHEREAS, the Town Council has carefully considered the Planning Commission's June 23, 2005, recommended text and map provisions; and WHEREAS, Town Council members have reviewed voluminous materials in conjunction with their review of amendments to the Town Plan, and these materials have been carefully considered; and WHEREAS, the Town Council believes that the Town's comprehensive plan should be amended and that it should adopt those text and map provisions set forth in the document attached hereto, entitled "Revised Draft Town Plan, September 13,2005" and; WHEREAS, the Town Council believes that these amendments ofthe Town's comprehensive plan will best guide and accomplish the coordinated, adjusted and harmonious future development of the Town, recognizing its present and probable needs and resources, and will best promote the health, safety, moraIs, order, convenience, prosperity, and general welfare of the Town of Leesburg and its inhabitants. THEREFORE, ORDAINED by the Council of the Town of Leesburg Virginia as follows: SECTION 1. The Town Council approves the amendment of the Town's comprehensive plan, and adopts as the 2005 Town Plan, those text and map provisions set forth in the document attached ·3- AN ORDINANCE: REVISING THE COMPREHENSIVE TOWN PLAN FOR THE TOWN OF LEESBURG hereto, entitled "Revised Draft Town Plan, September 13,2005." SECTION II: The Town Council authorizes Town staffto make punctuation, numbering and any related clerical-type changes to the text and maps of the 2005 Town Plan, so long as such changes do not alter the substance ofthe Council's adopted amendments; and SECTION III. The Town Council endorses the action programs and transportation cost data set forth in Appendices A and B to the document entitled "Revised Draft Town Plan, September 13, 2005," such appendices being attached to but not part of the 2005 Town Plan. SECTION IV: The 2005 Town Plan shall become effective at 12:01 AM on the 14th day of September 2005 Pass ed this 13th day of September 2005 ~t-~~ .. . C.
