HomeMy Public PortalAboutResolution 14-17 Adopting a Joint Wastewater Advisory Group CharterRESOLUTION 14-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MCCALL, IDAHO, ADOPTING A JOINT WASTEWATER ADVISORY GROUP CHARTER; PROVIDING FOR RELATED MATTERS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on August 28, 2014, the McCall City Council approved a Memorandum of Understanding with the Payette Lakes Recreational Water and Sewer District for effluent disposal; and WHEREAS, a requirement of the Memorandum of Understanding was the establishment of a Joint Wastewater Advisory Group for effluent disposal; and WHEREAS, a Joint Wastewater Advisory Group will serve to provide collaborative coordination and planning efforts between the City of McCall and the Payette Lakes Recreational Water and Sewer District; and WHEREAS, the charter establishes a formal structure and basic roles/responsibilities for the Joint Wastewater Advisory Group; and WHEREAS, the Joint Wastewater Advisory Group is recommended by staff; and WHEREAS, the McCall City Council approved the Joint Wastewater Advisory Group Charter at their regularly schedule Council meeting on September 11, 2014; and WHEREAS, the Payette Lakes Recreational Water and Sewer District Board made changes to and approved the Joint Wastewater Advisory Group Charter at their October 15, 2014 regularly scheduled meeting. WHEREAS, the McCall City Council approved the amended Joint Wastewater Advisory Group Charter at their regularly schedule Council meeting on November 6, 2014; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MCCALL, VALLEY COUNTY, IDAHO THAT: Section 1: The amended Joint Wastewater Advisory Group Charter attached hereto is hereby adopted. Section 2: This resolution shall be in full force and effect upon adoption. Passed and approved this 6 day of October 2014. Resolution 14-17 November 6, 2014 Page 1 of 2 CITY OF MCCALL Valley County, Idaho Resolution 14-17 November 6, 2014 Page 2 of 2 MCCALL AREA JOINT WASTEWATER ADVISORY GROUP CHARTER PURPOSE: The McCall Area Joint Wastewater Advisory Group is established pursuant to Idaho Code 50- 210 to advise and make recommendations to the McCall City Council and Payette Lakes Recreational Water and Sewer District (District) Board on matters pertaining to the collaborative operations, management, and consolidation of wastewater services. ORGANIZATION: This group shall consist of two McCall City Council members, two McCall City staff personnel, two District Board members, two District staff members, and engineers or legal counsel as needed. The City Council will make McCall City Council appointments to this group. Likewise, the District Board will make District appointments to this group. DUTIES: 1. Advise and make recommendations to City Council and District Board members on the development of an MOU which will outline a process and timeline for consolidation of City and District wastewater entities. 2. Advise and make recommendations to City and District staff on matters pertaining to collaborative efforts for operations and maintenance of wastewater collection, treatment, and disposal prior to the eventual consolidation of these entities. OFFICERS AND DUTIES OF OFFICERS: The Group shall have a Chairperson, Vice -Chairperson, and Secretary elected by the Group in the spring of each year and these duties shall rotate between McCall City Council members and District Board members annually. The Chairperson will serve as spokesperson to present recommendations to City Council and the District Board. The Chairperson, or selected designee, will convene the meeting and work with the staff to assist in matters outlined above under Group Duties. The Chairperson will provide copies of the agenda to be posted by the Secretary as required by Idaho Code. The Secretary shall assume responsibility for notifications and reminders for meetings, and will prepare Group minutes and present them for approval in a timely fashion. STAFF AND DUTIES OF STAFF: The McCall City Public Works Director and District Operations Manager shall serve as staff to this group. One additional staff member from the City and from the District, as appointed by each respective governing board, shall also serve as staff to this group. Staff shall assist the group as requested by undertaking research to provide information and correspondence as necessary to develop the best possible recommendations. Joint Wastewater Group Charter Page 1 of 2 October 15, 2014 CONDUCT OF MEETINGS/QUORUM: All meetings shall be open to the public. A quorum shall be five members. Recommendations to City Council and the District shall be made in the form of motions, a second and a vote recorded in the minutes. Recommendations to City Council or the District Board may be presented in writing or in person by the Chairperson, McCall City Public Works Director, District Operations Manager, or Committee Member(s) designated by the Chairperson. MEETING TIMES/PLACES: The Group shall meet once a month in a regular fashion on a specified day, time and place. Such a day, time and place shall be recorded on the city calendar and otherwise published. The Group may meet at other times as needed to meet critical timelines or upon the request of the Chairperson, City Council, the District Board, or staff. TERMS OF OFFICE: Group Members will serve 3-year terms. Individuals appointed to fill an unexpired term shall be appointed for the balance of that term. Members may be reappointed to this Group. Members may have business relationships with the City of McCall and District, however on any matter where a conflict of interest exists, such conflict shall be disclosed in full to group, and if a majority of the remaining Members do not affirmatively vote to accept and excuse said conflict, then the member having the conflict shall withdraw from debate and abstain from voting on the matter.
