The regular meeting of the City Council of the City of Temple City was called to order by Mayor Nunamaker at 7:30 P.M. 2. ORDINANCE NO. 64 -120 - Second Reading GRANTING A CHANGE OF ZONE ON PROPERTY ON WEST SIDE OF ARDEN DRIVE BETWEEN RANDW -I CK AND GREEN STREET FROM A -1 Acre. to R-1. City Manager Woollett read title to ORDINANCE NO. 64 -120. ORDINANCE NO. 64 -121 - Second Reading. AMENDING MUNICIPAL CODE SECTION 62.01 TO BRING COUNTY OF LOS ANGELES BUSINESS LICENSE ORDINANCE 5860, AS AMENDED, CURRENT TO JANUARY 13, 1964. City Manager Woollett read title to Ordinance No. 64-121. Councilman Dickason moved to waive further reading, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell',Nunamaker NOES: Councilmen -None ABSENT: Councilmen-None Councilman Dickason moved to adopt Ordinance Nc. 64 -121, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen- None PUBLIC HEARING: 7:30 P.M. - APPEAL FROM PLANNING COMMISSION DECISION ZONE CASE 63-71, N. W. Corner Broadway and Temple City Blvd. City Manager Woollett advised this Public Hearing be reset for 7:30 P.M. on February 10, 1964 as the residents in the area were not notified of the scheduled Public Hearing, through an 569 Council Minutes, January 27, 1964, Page 2 oversight on the part of the staff. Councilman Tyrell moved to reset the Public Hearing to 7:30 P.M. on February 10, 1964, seconded by Councilman Merritt and carried. PUBLIC HEARING: 7:30 P.M. - PROPOSED CONSTRUCTION OF SIDEWALKS EAST SIDE OF GOLDEN WEST, FLAHERTY TO GARIBALDI. Councilman Fitzjohn moved to open the Public Hearing and carries Assistant City Manager Koski apprised the Council of the situa- tion, stating that a petition was received by the City for side- walks on Golden West between Flaherty and Garibaldi. A Public Hearing was held on Sept. 9th and the project was found to be in the public interest. Since that time there has not been any basic change which would cause the sidewalk improvements not to be in the public interest. The staff recommends that the Council instruct the Superintendent of Streets to cause the work to be done, with a placement 6 inches from the front property line in accordance with other work on Golden West and City policy. Mayor Nunamaker asked for those wishing to speak in favor. Mr. Gaylord H. Bedell, 6126 Golden West addressed the Council stating that he was one of the original signers of the petition. He feels that there is no reason to change this proposal, that the proposition was honestly put forward with no misrepresenta- tion at any time. He also stated that he is ready to put the sidewalks in on his property regardless of the outcome. Mayor Nunamaker then asked for those who wished to speak against Mr. Edward Raith, 9803 Garibaldi, came forward stating that he, was away on vacation at the time the petition was circulated. He was under the impression that sidewalks would also be in- stalled from Woodruff to Garibaldi at this time, but since that petition has not been returned yet, would be in favor of post- poning sidewalks in his block till such time as Woodruff to Garibali is approved. Elizabeth Kinsley, 6115 Golden West also spoke against installa- tion of sidewalks. Councilman Merritt moved to close the Public Hearing, seconded by Councilman Fitzjohn and carried. Mr. Koski apprised the Council that all design and engineering has been completed on this project and that if the work were done at a later date it would cost more. Councilman Merritt moved that the petition against sidewalks on Golden West between Garibaldi and Flaherty be denied and that the work be resumed, seconded by Councilman Tyrell. City Manager Woollett recommended that the wording " that sidewalks be placed 6' from the property line' be added to the motion. Motion as amended carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt,Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None PUBLIC HEARING - 7:30 P.M. - CURB AND GUTTER: (a) Daines Drive, north side, Double Drive to Welland (b) Daines Drive, south side, Double Drive to Welland (c) Lora St. - south side, Pal Mal to cul -de -sac (d) Lora St. - north side, Pal Mal to cul -de -sac Councilman Fitzjohn moved to open the Public Hearing, seconded by Councilman Merritt, and carried. Mr. Koski explained that the petitions returned were signed by 71% for north side of Daines, 69.59% south side of Daines, 69.5% south side of Lora, and 65% north side of Lora. Mr. Nielson, 10663 Lora St. addressed the Council stating that he bought his home for the rural area, but feels that progress has come to us and we can't stand in the way, therefore he is in favor of curb and gutter. Councilman Tyrell moved to close the Public Hearing, seconded by Councilman Fitzjohn and carried. Councilman Tyrell moved to find the work to be in the public interest and to instruct the Superintendent of Streets to cause the work to be done, seconded by Councilman Merritt and carried by the following roll call vote: 570 Council Minutes, January 27, 1964, Page 3 AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamak€ NOES: Councilmen -None ABSENT: Councilmen -None 8. REQUEST FROM CAMELLIA FESTIVAL FOR SUBSIDATION OF TELEVISION COVERAGE OF PARADE: C. Ray Johnston, 6161 Oak Ave., President of Camellia Festival, addressed the Council stating that a communication from KTTV indicates an increase in the cost of coverage over last year, as well as an increase in the sponsors' fee. Mr. Johnston wishes to have the item tabled for two weeks in order to complete negotiations. He also stated that he felt that the City should very seriously consider sponsoring half of the advertising in subsequent years, as there is no better way of telling the public about our City and letting them know how proud we are. Councilman Fitzjohn moved to table this item until February 10, 1964, seconded and carried. NEW BUSINESS: 9. REVISED LAW ENFORCEMENT SERVICES AGREEMENT: RESOLUTION #64 -346. City Manager Woollett advised that the County has re -drawn the Agreement and in the opinion of the Committee this Agreement is superior to the previous one in that it puts the cities in a more favorable position whereby they can more closely control services through the Sheriff's Department. This Agreement is for a five -year period. Resolution No. 64 -346 authorizes the Mayor and City Clerk to sign the Agreement on behalf of the City. Councilman Tyrell moved to adopt Resolution No. 64 -346, and stated that one point on which the cities were not too happy was the fact that the Sheriff's Department establishes the level of services, although the Agreement may be terminated at any time. Motion seconded by Councilman Merritt and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 10. RESOLUTION NO. 64 -344 AMENDING '63-'64 BUDGET: City Manager Woollett advised that there were two changes as follows: (1) deletion of $50,000. for our share of Double Drive construction for which the contract will be let in March and the work will start in April. The City will not have to make any payments until next year. (2) In addition to the budgeted $25,869. for paveouts in conjunction with curb and gutter pro- jects, an additional $6,000. is requested. Total additional appropriations requested, $52,870. This means an increase of $2,870.00 over -all. Councilman Tyrell moved to adopt Resolution No. 64-344, seconded by Councilman Dickason and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 11. RESOLUTION NO. 64 -345 PROCLAIMING FEBRUARY 6, 1964 AS MARGE CALAMIA DAY. City Attorney Shatford read Resolution No. 6L: -345 PROCLAIMING MARGE CALAMIA DAY IN HONOR OF HER OUTSTANDING CONTRIBUTION TO CIVIC BETTERMENT IN TEMPLE CITY. Councilman Fitzjohn moved to adopt Resolution No. 64 -345, and send a certified copy to Marge Calamia, seconded by Councilman Dickason and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 571 Council Minutes, January 27, 1964, Page 4 12.. RESOLUTION NO. 64 -343 CPLLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION ON TUESDAY, APRIL 1 1964. City Manager Woollett read title to Resolution Nc. 64 -343. Councilman Merritt moved to approve Resolution No. 64 -343, seconded by Mayor Nunamaker and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 13. NEW CITY ZONING MAP: City Manager Woollett explained that if the Council approved the Zoning Map tonight then it would go to the Planning Commis- sion, staff and Consultants for finalization and should be back before the City Council in about a month. Councilman Merritt moved to approve the new Zoning Map, seconded by Councilman Tyrell and carried by the following roll call vote AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 14. PROPOSED NEW POLICY ON RE',UIRED CONSTRUCTION OF DRIVEWAY APRONS: AssistantCity Manager Koski explained the proposed °policy, which states that all driveway aprons must be constructed of Portland cement if curb has been constructed; if curb and gutter have noc been built, then the aprons may be constructed of fine pre -mix; if curbs have not been built but street design has been accepted and is available to contractor, then aprons shall be built of cement. The question arose as to the feasability of such a policy, and after considerable discussion with the City Attorney and the Planning Advisor, it was Felt that this should be in the form of a law rather than policy. Councilman Tyrell moved to instruct the City Attorney to draw an ordinance specifying type of material to be used in the con- struction of driveway aprons and approaches. Seconded by Coun- cilman Merritt and carried. Mr. Albert Anspach, 9565 Las Tunas Drive, President of the Business and Industrial Committee addressed the Council, stating he wished to submit a petition containing signatures of 64.62% of land owners in Parking District No. 2. The Committee has contacted businessmen in the area bounded by Temple City Blvd. and Kauffman Avenue who are interested in forming Parking Dis- trict No. 3. Mayor Nunamaker requested the City Council to certify the suf- ficiency of signatures on the petition for Parking District No. 2, seconded by Councilman Dickason and carried by the fol- lowing roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 15. RESOLUTION NO. 64 -342 WARRANTS AND DEMANDS IN THE SUM OF $41,297.33, DEMAND NOS. 4534 THROUGH 4562. City Manager Woollett certified that he finds these warrants to be accurate and the funds are available. Councilman Tyrell moved to approve Resolution Nc. 64 -342, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Meri -itt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 16. PLANNING COMMISSION RECOMMENDATIONS: (a) RESOLUTION NO. 64 -341 - CONSENTING TO THE COMMENCEMENT OF ANNEXATION PROCEEDINGS RELATING TO CERTAIN UNINHABITED REAL PROPERTY ON THE WESTERLY SIDE OF ROSEMEAD BLVD., NORTH OF LONGDEN AVENUE. 572 Council Minutes, January 27, 1964, Page 5 City Attorney Shatford explained this is a parcel located on the westerly side of Rosemead Blvd., north of Longden Avenue which is very desirous of coming into the City. Councilman Merritt moved to approve Resolution No. 64 -341, seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None (b) Recommend Deletion of Item No. 13 (c) on Tentative Tract No. 28317. Planning Advisor Cushman advised that Item No. 13 (c) was not required by the Subdivision Committee and was requested For deletion in the requirements. Councilman Merritt moved to approve, seconded by Councilman Tyrell and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None !!BSENT: Councilmen -None 17. TRAFFIC COMMISSION RECOMMENDATIONS: Item 6 - ORDINANCE NO. 64 -122 PROHIBITING THE MAINTENANCE OF CERTAIN CARTS, WAGONS AND STANDS WITHIN THREE HUNDRED FEET OF ANY PUBLIC SCHOOL GROUND. Assistant City Manager Koski advised that the Traffic Commissiox had received many complaints of icecream vendors in the vicinit of schools causing hazardous conditions with school children gathered about the truck, sometimes out to the middle of the street. City Attorney Shatford read title to Ordinance No. 64 -122. Councilman Fitzjohn moved to waive further reading, seconded by Councilman Tyrell and carried by the following roll call vote AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell,Nunarla ker NOES: Councilmen -None ABSENT: Councilmen -None 16. COMMUNICATIONS: None 19. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: (a) Richard Ingalls, 9556 E. Broadway, asked for an explana- tion as to why the public hearing was not held on the appeal to Planning Commission decision regarding the Zone Case 63 -71, and also stated that since he is a recent resident and not on the last Assessor's Role would like to be notified of the next Public Hearing. (b) Charles Oakley, 6164 Rosemead Blvd. advised the Council that Gabriel Janus is still operating to a degree in his garage. He was advised by the City Attorney that Janus' place is under surveillance and that when proof is fur?, nished then the City can take action, but not before. (c) Robert G. Rains, 6438 Golden West, asked why it is not the final responsibility of the Chamber of Commerce to assume the financial burden of television coverage for the Cam- ellia Parade. He was informed that most Chambers are par- tially subsidized by the City. 20. MATTERS FROM CITY OFFICIALS: (a) Councilman Fitzjohn asked when the bike racks would be installed and was informed that they would be placed next week. (b) City Manager Woollett advised that Zone Variance Case No. 375, Robert C. & Rojean L. Bitten has been requested for appeal and a Public Hearing should be set. Councilman Tyrell moved to set a Public Hearing on February 24, 1964 at 7:30 P.M., seconded by Councilman Merritt and carried. 573 Council Minutes, January 27, 1964, Page 6 (c) City Manager Woollett asked for authorization of expendi- ture of $695.97 to do the necessary wiring, etc. to put the present sound system into the new City Hall.
