and Light Company. Mr. Simons wanted to know if there wasn't some
way the issue could be forced and the Florida Power and Light would
have to buy the system. Mr. Webb suggested that the best solution
was possibly to have a meeting with Mr. Graham, Sr. or each council-
man to speak to him personally and see if things could be moved along
a little faster.Nr. Simons asked that Mr. Whittaker be contacted and
asked to bring the Florida Power and Light specifications for our
system to the next meeting.
Mr. Simons wanted to know what the situation was with regard
to Bal Harbour Village and the proposed commercial section. Mr.
Webb explained that all the planning for this section was under the
supervision of Mr. Harland Bartholomew and he 'as sure that what-
ever plan they decided upon would be for the best of the community.
Upon motion of Mr. Beatty, seconded by Mr. Simons, the meet.

The Council of Bal Harbour Village met at the Administration
Building, Monday, April 23, 1951 at 8:00 o'clock P. M.
There were present: Messrs. Beatty, Simons, Stokely and
Whittaker.
Absent: Mr. Graham, Jr.
Also present were Mr. W. H. Webb, Village Manager;., Mary Wetterer,
Village Clerk; and Fred Minden, Village Attorney.
In the absenoe of the Mayor, Mr. Graham, Jr, Mr. Simons presided
it the meeting.
The minutes of the previous meeting of March 19, 1951 were read
and approved.

Mr. Webb informed the council that Mr. DuPree, co-owner of two
apartment buildings in the village, was going to submit a letter to
the council requesting permission to o-en part of one of the ocean
front lots owned by Mr. Froedtert for a bathing beach for their enact-
ment houee tenants. After discussion it w-Ls decided that no action
would be taken on the matter until the letter was presented.
The six months audit of the Village's ooeration was sumbitted
and after discussion was approved by the members.
Miss Wetterer reported that four petitions had been filed for
the council election to be held May 1st, the candidates being Harry
A. Brown, George N. Leonard, Albert E. Schrader, end Edward G. Stokely.
The registration list of qualified electors in the village was then
ubmitted to the council and as no names were purged from the record
it was decreed that there were 69 qualified electors for the coming
election. Mr. Baisden suggested that the council keep the subject of
absentee ballots in mind and decide on the policy f-u• the next
council election to be held in Mr:y 1953.
Mr. Webb submitted to the c)uucil a sketch of a sign to be
placed on the side of the r,'nerald Isle Hotel reading "1007J Air Condit-
ioned" left for approval by the Electro Neon Sign Company. After
discussion it was moved by Mr. Beatty, seconded by Mr. Stokely that
the request for an additional sign on the Emerald Isle Hotel be rejected
and the motion was carried.
Mr. Webb said that in reality the Board of Appeals discussed in
the previous council meetings is actually only to hear compls.i.^.ts and
that he believed an ordinance should. be drafted setting up a regular
planning board. Mr. Baisden said that he thought that perhaps there
were too many steps involved to get plans approved and that Mr. Webb
could pass on the plans both for the structural and esceticae sense,
and any decision of his could be appealed to the council. After dis-
cussion this question was left to the town attorney to be brought up
at the May 14th meeting.
Mr. Simons said that he had been appointed to serve with the Pro-
curement Unit of the Civil Defense program and asked permission to
use the Administration Building as a Headquarters durint; an emergency.
Mr. Webb said that he has sure this would be alright.
Mr. Simons asked Mr. Whittaker if he ha- the specifications for
the Florida Power and Light installation with him. Mr. Whittaker
maid he had the contract which embodied thm specifications for the under-
ground. After consideration of the contract Mr. Simons asked if it was
the fault of the system that the cable burnt out so frequently, part-
iculary after rains. Mr. Whittaker s.id that when Mimi Beach Heights
installed the system they were told that no expense was to be ;pared
for the installation and just such a system w,s put in. He explained
that what had happened could not have been foreseen and that it was
electrosis that was eating the cable mostly in the a,•ea at the north
end which had been filled in late. He also said that Miami beach
Heights, at their own expense, had authorized a system to be installed
to protect the cable by drawing off ground currents by setting anodes
in the water off Balf)ur Drive and placing rectifiers to draw the
currents off. Mr. Whittaker said that Neophrene cable should have been

used, but at the time the system was installed this type of cable was
too new to be recommended. Mr. Whittaker was asked if the Florida
Power and Light Company had ever formally accepted the system and he
said that when they energized it that constituted acceptance. Mr.
Simons asked if after the year's agreement for s.:rvice ended if they
could refuse to renew the agreement and Mr. 8a.isden said it was his
personal opinion that the Railroad Commission would make them keep
the servi;e up. Mr. Simons wanted to kn m if the people didn't buy
the utility when they bought the lots. Mr. Webb said no.
Mr. Canfield asked the council if he could explain about a sugges-
tion made at the last volunteer fireman': meeting regarding placing of
ladders or some sort of pole over the seawalls in order to enable pco le
to climb up in case of an overturned boat or someone falling in. The
council agreed that they approved of the interest the volunteers were
taking and s.g;ested they give the matter more thought and really have
a workable plan to present.
The council considered the following plans and approved or rejected
them as follows: Breuil addition, approved; Simkins addition, approved;
Wilson residence, approved; Corcoran apartment, approved; Frederick
residence, approved; imerald Isle Hotel sign, rejected.
Upon motion of Mr. Beatty, seconded by Mr. Whittaker the meeting
adjourned.
