ORDINANCE NO. 2005-O-17 ADOPTED December 13, 2005
AN ORDINANCE: AMENDING SECTIONS 15-56, 15-57, 15-58, 19-42, 19-45 AND 19-46 OF THE
TOWN CODE REGARDING WATER AND SEWER FEES
WHEREAS, the Leesburg Town Council authorized Municipal and Financial Services Group
(MFSG) to conduct a water and wastewater cost of service analysis for the period of FY 2006-2015; and
WHEREAS, MFSG found the current user rates for water and wastewater do not produce sufficient
revenue to cover revenue requirements for FY 2006 and several following years; and
WHEREAS, the Town of Leesburg is committed to fair and equitable user rates for water and sewer
services, and
WHEREAS, the proposal to increase the financial burden on out-of-town customers is predicated
on the fact of economic fairness to in-town constituents; and
WHEREAS, prior to 1992, all bonded indebtedness on behalf of the Utility Fund was issued as
"general obligation" bonds which are pledged on the "full faith and credit" of the Town of Leesburg
government, whereby, in the event of default by the Utility Fund, the burden of repayment falls on the
general government, to which the out-of-town customers have no obligation; and
WHEREAS, even though the Town of Leesburg has prudently planned for meeting water and
sewer demands in its service area, it is physically limited in its ability to provide water and sewer capacity
for new construction. Providing utilities to out-of-town customers may, at some future point in time,
impact the town's ability to provide utility service to in-town customers, there-by, potentially impeding
economic development and impacting resident's real tax rates; and
WHEREAS, the Leesburg Town Council conducted a public hearing on November 22, 2005 and
recommended approval of the proposed amendments.
AN ORDINANCE:

AMENDING SECTIONS 15-56, 15-57, 15-58, 19-42, 19-45 AND 19-46 OF THE
TOWN CODE REGARDING WATER AND SEWER FEES
THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. Section 15-56 of the Town Code is amended to read as follows:
Sec. 15-56. Generally.
Charges for the use of the public sewage works of the Town shall be as provided in this article.

SECTION II. Section 15-57 of the Town Code is amended to read as follows:
Sec. 15-57. Charge where connection made to both water and sewer system.
Where connection has been made to both the Town water and sewer system, the charge for use of the
sewer system shall be based on time and quarterly water meter readings taken to the nearest 1,000 gallons
based upon the winter quarter metered water consumptiOn at the following rates:
(1) For premises inside the Town, the rate shall be $3.21 $3.34 per 1,000 gallons, effective January 1,
2006. Rates for premises inside the Town shall increase to $3.61 per 1,000 gallons effective July 1, 2006,
$3.89 per 1,000 gallons effective July 1, 2007, $4.21 per 1,000 gallons effective July 1, 2008, and $4.33
per 1,000 gallons effective July 1, 2009.
(2) For premises outside the Town, the rate shall be $2.59 $6.68 per 1,000 gallons, effective January
1, 2006. Rates for premises outside the Town shall increase to $7.21 per 1,000 gallons effective July 1,
2006, $7.79 per 1,000 gallons effective July 1, 2007, $8.41 per 1,000 gallons effective July 1, 2008, and
$8.66 per 1,000 gallons effective July 1, 2009.
Until a winter quarter metered water consumption is established, sewer charges shall be based on a
consumption of 288 gallons per day for all residential single-family detached dwellings.
Sec. 15-57.1. Fixed charRe per quarter.
When a connection has been made to both the Town water and sewer system, the fixed charge per quarter
for use of the sewer system shall be based upon the size of the water meter used to serve the customer and
said fixed charge per quarter shall be as follows:

SECTION III. Section 15-58 of the Town Code is amended to read as follows:
Sec. 15-58. Charge where connection made to sewer system only--Generally.
Where connection has been made to the Town sewer system only, the charge for use of the sewer system
shall be as follows:
(1) For premises inside the Town, the rate shall be $59.00 $87.00 per quarter, effective January 1,
2006. Rates for premises inside the Town shall increase to $94.00 per quarter effective July 1, 2006,
$101.00 per quarter effectiVe July 1, 2007, $110.00 per quarter effective July 1, 2008, and $113.00 per
quarter effective July 1, 2009.
(2) For premises outside the Town, the rate shall be $5~.99 $174.00 per quarter, effective January_ 1,
2006. Rates for premises outside the Town shall increase to $188.00 per quarter effective July 1, 2006,
$203.00 per quarter effective July 1, 2007, $219.00 per quarter effective July 1, 2008, and $225.00 per
quarter effective July 1, 2009.

Sec. 15-58.1. Same. Lower charge for certain elderly homeowners or totally and permanently
disabled homeowners.
The charge for use of the sewer system to elderly or totally and permanently disabled residents at their
principal dwelling who annually qualify for full exemption of Town real estate taxes under section 17-1.1
of the Town Code (Tax Relief for the Elderly and Totally and Permanently Disabled) shall be 75 percent
of the established rate for inside the Town.
SECTION IV. Section 19-42 of the Town Code is amended to read as follows:

Sec. 19-42. Generally
Rates and fees for the use of the public waterworks of the municipality shall be as provided in this article.

SECTION V. Section 19-45 of the Town Code is amended to read as follows:
Sec. 19-45. Rates established.
The charge for use of water from the Town water system shall be based on quarterly meter readings taken
to the nearest 1,000 gallons at the following rates:
(1) For premises inside the Town, the rate shall be $2.67 per 1,000 gallons. Rates for premises inside
the Town shall increase to $2.86 per 1,000 gallons effective July 1, 2006, $3.06 per 1,000 gallons
effective July 1, 2007, $3.15 per 1,000 gallons effective July 1, 2008, and $3.24 per 1,000 gallons
effective July 1, 2009.
(2) For premises outside the Town, the rate shall be $3.97 $5,34 per 1,000 gallons, effective January

effective July 1, 2006, $6.11 per 1,000 gallons effective July 1, 2007, $6.30 per 1000 gallons effective
July 1, 2008, and $6.49 per 1,000 gallons effective July 1, 2009.
(3) If metered water consumption during any quarter other than the designated winter quarter shall
exceed the winter quarter water consumption by 35 percent then the rate shall be increased by 36 percent
for the affected quarter.

SECTION VI. Section 19-46 of the Town Code is amended to read as follows:

SECTION VII. This ordinance shall be in effect for billings after April 1, 2006.
