HomeMy Public PortalAbout2006_03_28_O005 Amending the ZO re admin approval of Historic District Permits The Town of Leesburg, Virginia PROPOSED: March 28, 2006 ORDINANCE NO. 2006-0-5 ADOPTED: March 28, 2006 AN ORDINANCE: TO AMEND AND REORDAIN SECTION 7.5.6 (ADMINISTRATIVE APPROVAL OF HISTORIC DISTRICT PERMITS) ARTICLE 7 (OVERLAY AND SPECIAL PURPOSE DISTRICTS); SECTION 15.11.1 (HISTORIC DISTRICT ZONING PERMIT REQUIRED) AND SECTION 15.11.4 (AREA, HEIGHT, NUMBER AND LOCATION OF SIGNS) BOTH OF ARTICLE 15 (SIGN REGULATIONS) ALL OF THE ZONING ORDINANCE OF THE TOWN OF LEESBURG, VIRGINIA, 2003 AS AMENDED THEREFORE, ORDAINED by the Council of the Town of Lees burg in Virginia as follows: SECTION I. That Section 7.5.6 (ADMINISTRATIVE APPROVAL OF HISTORIC DISTRICT PERMITS) of Article 7 (OVERLAY AND SPECIAL PURPOSE DISTRICTS), be and the same hereby is amended to read as follows: Sec. 7.5.6 Administrative Approval of Historic District Permits A. Lighting, Fences, Paving and Color. The Preservation Planner shall have authority to issue a Historic District Permit for applications to install or alter lampposts, light fixtures, fences, driveways or residential walkways and applications to change an existing exterior color scheme. If the Preservation Planner determines the application may not be in compliance with the Old and Historic District Design Guidelines, the application shall be forwarded to the Board for consideration at the applicant's request. B. Signs. The Preservation Planner shall have authority to issue a Historic District Permit for applications that request approval for signs that conform to the criteria as established in the Old and Historic District Sign Guidelines in the section titled "Administrative Approval Criteria for Signs in the Old and Historic District". In the event the Preservation Planner determines that the sign does not conform to said guidelines the application shall be forwarded to the Board for consideration at the applicant's request. SECTION II. That Section 15.11.1 (HISTORIC DISTRICT ZONING PERMIT -2- AN ORDINANCE: PROVIDING AMINISTRATIVE APPROVAL OF SIGNS IN THE OLD AND HISTORIC DISTRICT REQUIRED) of Article 15 (SIGN REGULATIONS), be and the same hereby is amended to read as follows: Sec. 15.11.1 Historic District Zoning Permit Required New signs or changes in text, color or composition to an existing permanent sign within the Historic District require the approval of a Historic District Permit by either the Board of Architectural Review in accordance with Sec. 7.5.5 Historic District Permits, or the Preservation Planner in accordance with Sec. 7.5.6 Administrative Approval of Historic District Permits and the issuance of a sign permit by the Zoning Administrator. SECTION III. That Section 15.11.4 (AREA, HEIGHT, NUMBER AND LOCATION OF SIGNS) of Article 15 (SIGN REGULATIONS) be and the same hereby is amended to read as follows: Sec. 15.11.4 Area, Height, Number and Location of Signs The area, height, number and location standards for signs erected in the H-I Overlay District shall be determined by the Board of Architectural Review in accordance with the Old and Historic District Design Guidelines during the Historic District Sign Permit review process. In making determinations that differ from the design standards contained in Sec. 15.7, Sec. 15.8 and Sec. 15.9, The Board shall be guided by the Old and Historic District Design Guidelines. SECTION IV. This Ordinance shall become effective upon the date and at the time of its final passage. SECTION V. Severability. Ifany provision of this ordinance is declared invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of the ordinance. -3- AN ORDINANCE: PROVIDING AMINISTRATIVE APPROVAL OF SIGNS IN THE OLD AND HISTORIC DISTRICT PASSED this 28th day of March 2006. ~Q~ .
