AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, AMENDING CHAPTER 19 OF THE
CODE OF THE CITY OF OPA-LOCKA, ENTITLED "STREETS AND
SIDEWALKS," BY AMENDING ARTICLE I, ENTITLED "IN
GENERAL," BY CREATING SECTION 19-8 TO BE ENTITLED
"ADOPT-A-ROAD"; PROVIDING FOR INCORPORATION OF
RECITALS; PROVIDING FOR ADOPTION OF ARTICLE; PROVIDING
FOR AUTHORITY; PROVIDING FOR CODIFICATION; PROVIDING
FOR SCRIVENER'S ERRORS; PROVIDING FOR CONFLICT;
PROVIDING FOR LIBERAL CONSTRUCTION; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR EFFECTIVE DATE.
WHEREAS, the Adopt-A-Road Program is an important way to beautify the City of
Opa-Locka ("City"); and
WHEREAS, Local organizations, private corporations and volunteer groups alike gather
together to perform litter removal along the County's roadway system equaling or exceeding one
mile in length.
WHEREAS, in the spirit of encouraging public participation in timprovig the
appearance of the City; the Mayor and City Commission desire to enact the Adopt-A- Road
Program
NOW, THEREFORE, BE IT DULY ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS:
SECTION 1. RECITALS.
The above recitals are true and correct and incorporated herein as though fully set forth
below.
Ordinance No. 18-05
SECTION 2. TITLE.
This provisions of this Section will be entitled "Adopt-A-Road'.
SECTION 3. AMENDING CHAPTER 19 OF THE CODE OF THE CITY OF
OPA-LOCKA, ENTITLED "STREETS AND SIDEWALKS," BY AMENDING
ARTICLE I, ENTITLED "IN GENERAL," BY CREATING SECTION 19-8 .
Section 19-8 is hereby created to state as follows:
(a)Eligibility Requirements and Rules
All participants in litter removal activities must attend a safety pre-task briefing prior to
taking part in cleanups. The following recommendations have been developed by the
Florida Department of Transportation for groups participating in litter control programs.
(1) In order to participate:
• All participants must wear high visibility safety vests at all times during
the litter removal activity.
• Remove litter when the weather is good, during the daylight hours only.
• Do not bring persons to observe the activity if they are under the age of
16.
• No horseplay of any type will be tolerated.
• No intoxicating liquid, beverage or illegal drugs will he allowed.
• Persons participating should wear gloves, a good quality shoe (no open toe
shoes, sandals or flip flops) and light or bright colored protective clothing.
No clothing will be allowed that hinders sight of the participant or may
distract passing motorists.
• An adequate supply of drinking water should he readily available.
• A good pair or sunglasses. gloves, hat and sun block should be considered.
• Do not pick up litter at construction or maintenance sites, on bridges, or
overpasses.
• Carpool to the adopted roadway section to keep the number of cars on the
roadside to a minimum.
• Park oft the roadway as far away from the pavement as possible. Keep
vehicles on the same side of the highway as participants. Return to and use
your vehicles to transfer to the other side of the roadway.
• Participants should work facing oncoming traffic whenever possible and
work one side of the roadway at a time. Do not enter the roadway or its
shoulder areas at any time.
• Avoid suspected toxic/hazardous substances, poison ivy, poison oak,
noxious weeds; areas where herbicides were applied recently; places
where snake, fire ants or other insects may be located. Do not pick up
unknown or hazardous materials: note their location on your cleanup
report.
• Bring along a cellular phone if one is available.

(2) In case of emergency:
• Every crew should possess and adequate FIRST AID KIT. Treat all
injuries no matter how minor appearing.
• Know the route from work site to the nearest emergency center or
hospital in case of serious injury. Have transportation immediately
available.
(b)Benefits include:
(1) Roadway signage announcing your company's name partnership.
(2) Kick-off event to recognize your investment in the community.
(3) Review of landscape plan.
(c) Sponsorship Levels:
(1) Green Sponsor: $25,000 for two years, with first rights to renew.
(2) Silver Sponsor: $15,000 for two years.
(3) Bronze Sponsor: $7,500 for one year.
SECTION 2. CONFLICT AND REPEALER.
All ordinances or resolutions or parts of ordinances or resolutions and all sections or parts
of sections in conflict herewith, are hereby repealed.
SECTION 3. CODIFICATION.
It is the intention of the City Commission, and it is hereby ordained that the provisions of
this ordinance shall become and be made part of the Code of the City of Opa-locka as
amended; that the sections of this ordinance may be renumbered or re-lettered to
accomplish such intention; and that the word "ordinance" may be changed to "section" or
other appropriate word.
SECTION 4. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the
remainder shall not be affected by such invalidity.
SECTION 5. SCRIVENER'S ERRORS.
Sections of this Ordinance may be renumbered or re-lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or City Manager's designee, without need of public hearing, by filing a
corrected or re-codified copy of the same with the City Clerk.
SECTION 6. LIBERAL CONSTRUCTION.
The terms and provisions of this Ordinance shall be liberally construed to affect the
purpose for which it is adopted.
SECTION 7. EFFECTIVE DATE.
This Ordinance shall take effect immediately upon the adoption and subject to the
approval of the Governor of his designee.
