The Tiffin Planning and Zoning Commission met in regular session on Wednesday,
March 7, 2012 at the Springmier Community Library. Chairperson Kate Fitzgerald
called meeting to order at 6:35 p.m. Members present: Melvin Reeve and Stephanie
Surine. Absent: Jim Schmidt and Shawna Colvin. Also present: Attorney Greenleaf.
Mayor.Berner and Travis Weipert.
Motion Surine second Reeve to approve agenda with the clarification that the setback
discussion concerns R-2 zones (not PAD) and with the notation that the commission will
also review the current trails map for accuracy. Carried unanimously.
Motion Surine second Reeve to approve minutes of February 1, 2012. Carried
unanimously.
Rezoning Request for Lot 48 and.Outlot C in Timber Ridge View Estates
Motion Surine second Reeve to deny request from City of Tiffin to rezone lot 48 and
outlot C of Timber Ridge View Estates from R-2 to PAD (planned area development)
due to the fact that the area is 4.97 acres and the minimum size requirement for a PAD
is 5 acres. Carried unanimously
P&Z commission members consensus that they do not foresee any problems with the
board of adjustment granting a variance for the PAD because the area is .03 acres less
than the size requirement and owners of PAD zones must seek council approval for the
planned area development before they begin to build.
Subdivision Ordinance
Fitzgerald reported that the subdivision ordinance is in the process of being typed and
she will send an electronic copy to the members so they can view the edits. Item
placed on the next P&Z meeting on April 4, 2012.
Noise in Commercial Zones
Fitzgerald reported that Attorney Greenleaf brought the issue of noise regulation in
commercial zones to the city council's attention last month. The city does not have
noise regulations in commercial or light industrial zones.
Greenleaf stated that the city currently uses a decibel standard in other zones, but that
no one has equipment to measure decibels and if prosecuted, the city has to get
equipment and convince a judge that it is trustworthy. Another issue is whether to
measure the noise at its source or at the reception site, and where two zones adjoin,
which standard should apply. The further from the origination site of the noise, the more
difficult it would be to measure or prove the noise level. Also, the city currently has a
noise ordinance, but industrial noise is addressed in the zoning ordinance rather than
the noise ordinance, probably due to the fact that there are a lot of regulations regarding
industrial zones. Most people would look to the noise ordinance first.
General discussion concerning how to establish noise levels without being too
restrictive and how to establish exceptions such as lawn mowers and leaf blowers.
Commission consensus to add the regulation to the current noise ordinance and to
measure the noise from the point of origination. Commission asked Greenleaf to make
a recommendation and placed the item on the P&Z agenda for April 4, 2012.
Setbacks for R-2 Zones
Berner reported that the setback requirement on corner lots in all residential zones is'15
feet for the principal structure, with the exception of R-1 E and R-2. The R1-E zone is a
larger residential lot used for "high end" housing. He stated that the current R-2 corner
lot setback requirement of 20 feet might have been an oversight in developing the
ordinance and recommended that the setback requirement on corner lots in R-2 zones
be changed to 15 feet to be consistent with other residential zoning.
Motion Surine second Reeve to recommend to the city council that the P&Z Ordinance
be amended in regard to the setback requirement for corner lots in R-2 zones from 20
feet to 15 feet. Carried unahimously.
Bike Trails
Commission members reviewed the bike trail map from the MPO (Municipal Planning
Organization) for accuracy and will report to council representative Chris Ball.
Motion Reeve second Surine to adjourn at 7:15 p.m. Carried unanimously.

I just talked with Steve Greenleaf concerning the following issues:
Attached is the city's application for re-zoning of lot 48 and outlot C in Timber Ridge
from R-2 to PAD. Also attached is the drawing and list of property owners within 200
feet of the area. Our scanner puts documents into a photo format. You might need to
save it to"your desktop and open those in Microsoft Word.
It is my understanding, from our city attorney, that the P&Z commission can add this
item to its regular meeting on March 7. It is also my understanding that, due to the fact
that the area does not meet the minimum size requirements, the P&Z would
recommend denial of the application. Upon denial by the P&Z, the city applies for a
variance'to the board of adjustment. The board of adjustment schedules a public
hearing and notice is sent to the property owners within 200 feet.
Please let me know to add this item to your March 7 agenda. As soon as I hear from
you, I will email the application packet to the other commission members.
At the Feb. 8th meeting, the council discussed the lack of language in the ordinance
concerning regulation of noise in commercial zones and asked the P&Z to make a
'recommendation. You indicated that you would, seek assistance from Steve Greenleaf
on this issue. His email is listed above., Please let me know if you want to add this
item to your March 7 agenda, also, or if it would be better timing to add it to your April
meeting.
I will be out of the office on Wednesday, Feb. 29, but can respond to your emails on
Thursday.

RE: Agenda Items
Two items on our agenda require some explanation:
1. Noise in Commercial Zoned areas. It was brought up at the February City Council meeting that
we have noise ordinances in residential and industrial but not commercial. With the new bar
opening it has been recommended that we create a noise ordinance for commercial. Particular
attention needs to be paid to residential surrounding the commercial zoned business.
2. Mayor Berner brought to my'attention that"R2 Zoning requires a setback of 20 feet on corner
lots for principal use &structure. The other residential zoning classifications require setbacks of
15 feet on corner lots (except R1E: 25 feet). Do you Know if a reason exists for this difference in
R2 Zoning? I think when the Zoning classifications were changed and rewritten (in 2007),this 20
foot setback in,R2 Zoning was a mistake.All R1A, R1B, R1C,R4, R6, R8, R12,and RM have 15 foot
set backs on corner lots. I would like the P&Z Commission to consider changing Corner Lot

setbacks for Principal Uses&Structures in R2 Zoning to be changed to 15 feet to fall in line with
the other Residential Zoning Districts with exception of R1E."
