RESOLUTION AUTHORIZING THE PLANNING BOARD TO
CONDUCT AN "IN NEED OF REDEVELOPMENT" STUDY
PURSUANT TO THE LOCAL REDEVELOPMENT AND HOUSING
LAW, N.J.S.A. 40A:12A-1 et seq.
WHEREAS, pursuant to Ordinance No. 95-40 adopted on August 17, 1995 and
Ordinance No. 96-14 adopted on May 16, 1996, the Borough of Carteret ("Borough")
created and expanded, respectively, a Landfill Reclamation Improvement District
affecting certain properties in the Borough as referenced therein (the "District") in
accordance with the Large Site Landfill Reclamation and Improvement Law (codified at
N.J.S.A. 40A:12A-50 et seq.) (the "Landfill Law");
WHEREAS, by the above referenced Ordinance adopted on August 17, 1995, the
Borough also designated Bellemead Development Corp. ("Bellemead") as the
"redeveloper," and subsequently entered into a redevelopment agreement relating to the
District ("Bellemead Agreement");
WHEREAS, on February 6, 2004, the Borough executed a Redevelopment Agreement
(the "Redevelopment Agreement") with Titan-PDC Carteret, LLC ("Redeveloper")
pursuant to which the Bellemead Agreement will be terminated and Redeveloper will
develop a redevelopment project within the District, subject to the terms and conditions
in the Redevelopment Agreement; and
WHEREAS, in order to insure satisfaction of all potentially relevant legal requirements,
the Borough has determined to authorize an investigation, pursuant to the Redevelopment
Law, of that portion of the District known in the Redevelopment Agreement as the Phase
I Project Site to determine whether said area is in need of redevelopment.
NOW, THEREFORE, BE IT RESOLVED, the Borough Council hereby authorizes the
Planning Board of the Borough of Carteret to conduct a preliminary investigation to
determine whether the area described on Exhibit A hereof is a redevelopment area
according to the criteria set forth in section 5 of the Redevelopment Law and to make
recommendations to the Borough Council. The Planning Board shall make
recommendations to the Borough Council as required by law.
BE IT FURTHER RESOLVED, that a duly executed copy of this resolution shall be
filed in the office of the Borough Clerk.
