PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Evan Mann, City Attorney Andrew Rawlings, Public Works Director Zech Prouse and City Clerk/Treasurer Keri West. ABSENT: None. VISITORS: James West. Mayor Gubler welcomed everyone, and Council Member Wadsworth led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Regular Meeting Minutes of October 18, 2022 and City Council Special Meeting Minutes of November 3, 2022 were reviewed. Council reviewed the finance reports for the period ending October 31, 2022 (8% of the fiscal year elapsed). The City had$2,648,252.52 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council President Geray made a motion to approve the consent agenda as presented. Council Member Thompson seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Appointment of Clint Reading and Reappointment of Ray Hart to Planning & Zoning Commission—Mayor Gubler stated Clint Reading and his wife own Jill's Chicken Shack and he comes highly recommended and has experience serving on various boards. Mayor Gubler stated Mr. Reading worked as a Dean at the College of Eastern Idaho prior to moving to Iona and opening Jill's Chicken Shack. He continued and stated he has spoken with Mr. Reading and he seems excited to serve on the City's Planning & Zoning Commission (P&Z). Mayor Gubler stated Mr. Reading will take the place of Gary Elliott on the P&Z as his term is up and he chose not to be reappointed. Mayor Gubler also stated Ray Hart has served one term on the P&Z and chose to continue for a second term. Council President Geray asked James West, P&Z Chairman, his thoughts on these appointments. Chairman West stated he recommended them to Mayor Gubler and is happy they have both accepted. Clerk West stated Mr. Reading and Mr. Hart were both unable to attend tonight's meeting, so she will attend the next P&Z Meeting to swear them in. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Clint Reading and Ray Hart as Members of the Planning & Zoning Commission for the City of Iona. Council Member Thompson seconded the motion. All in favor. Motion carried. Ordinance to Amend Ordinance No. 280-08-22, Appropriations Ordinance for the 2023 Fiscal Year Appropriating Additional Monies of $443,761.33 to reflect accurate fund balance carryover amounts (Ord. 283-11-22)—Mayor Gubler stated when this Ordinance was passed in August, the Council agreed to revisit the budget when the numbers have been finalized for the previous fiscal year. He continued and stated we now have accurate rollover amounts IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 15, 2022 from last year, so the budget will be increasing to reflect those amounts. Council President Geray stated part of those carryover funds will be used to buy a new dump truck and will be split between the General Fund and the Water Fund. He continued and stated some of the carryover funds from the Water Fund will be used to pay an additional payment on the water bond. Council President Geray also verified that carryover funds for the Recreation Department were not included in the total General Fund carryover funds. Clerk West confirmed the funds that carried over for the Recreation Department were separated from the General Fund carryover balance. She continued and explained the Recreation Director raised the registration fees last year and did not expense that much in hopes of saving the rest for a larger project in the future. Clerk West continued and stated the Recreation budget typically does not carryover from one year to the next, but she felt it was appropriate because there was approximately $23,000 in unexpended revenue that was brought in specifically for Recreation and should be used by Recreation. Clerk West also stated this amended budget captures the $50,000 grant for the tennis court project that was not received until this fiscal year. Mayor Gubler asked if anyone in the audience had any comments or concerns regarding this Public Hearing. No comments made. Mayor Gubler then asked if anyone from the Council had any additional questions. No response. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 283-11-22, an Ordinance of the City of Iona, Idaho; amending Ordinance No. 280-08-22, the Appropriations Ordinance for the Fiscal Year beginning October 1, 2022, and ending September 30, 2023; appropriating accurate amounts for fund balance carryovers by the City of Iona, Idaho, in the sum of$443,761.33 and providing an effective date. Council President Geray also moved to dispense with the rule of reading the proposed Ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member Thompson: YES Council Member Mann: YES Ordinance to Amend Iona City Code 10-1 Subdivision Ordinance, pertaining to Road Cross Section Designs for new developments (Ord. 284-11-22) — Mayor Gubler stated this discussion took place in the Work Meeting that immediately preceded this Regular Meeting. He continued and stated the Council discussed their concerns and agreed on the details at that meeting. Mayor Gubler stated this is a Public Hearing and asked if anyone from the audience had any comments or questions on this agenda item. No response. Mayor Gubler closed the Public Hearing portion of this agenda item and moved into deliberation amongst the Council. Attorney Rawlings explained this amendment pertains to the Iona Subdivision Ordinance. He continued and stated in that Ordinance there are Standard Specifications and Drawings the City has adopted. He stated this amendment pertains specifically to the Road Cross Section design in that document. Mayor Gubler stated the Road Cross Section design that is being adopted is the same design Bonneville County uses. Council President Geray stated the date on the bottom of the attached drawing is "11/15/2021" and should be "11/15/2022". Mayor Gubler confirmed that should be part of the motion to approve. 2 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 15, 2022 Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ordinance No. 284-11-22, an Ordinance of the City of Iona, Idaho; amending Section 10-1-17(E) of the Iona City Code; clarifying and incorporating drawings of road cross-sections to be used in the City; providing methodology; preserving prior Ordinances in each instance; providing for severability; and establishing an effective date, and that the design be amended to include a "25 year storm event" requirement instead of a "10 year storm event" and percolation tests shall be required, not on a case by case basis, and the date on the design should be changed to "11/15/2022". Council Member Wadsworth also made a motion to dispense with the rule of reading the proposed Ordinance in full and on three separate occasions. Council Member Thompson seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Mann: YES Council Member Thompson: YES Council Member Wadsworth: YES Approval of Legal Services Proposal, Fiscal Year 2023 for Holden, Kidwell, Hahn & Crapo, P.L.L.C. — Mayor Gubler stated this is the proposal for Attorney Rawlings as the City Attorney. He continued and stated the rate increase is from $180/hour to $190/hour. Mayor Gubler asked if anyone had any questions. Council President Geray noted the contract includes representation at P&Z Meetings in addition to City Council Meetings. Attorney Rawlings stated he has attended P&Z Meetings when his presence is requested. Clerk West confirmed. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the Legal Services Proposal between Holden, Kidwell, Hahn & Crapo and the City of Iona for Fiscal Year 2023. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Discussion of Bonneville County Area of Impact Agreement — Mayor Gubler stated this discussion began at tonight's earlier Work Meeting. Attorney Rawlings stated the current Area of Impact Agreement (AOIA) is a good guideline of what needs to be discussed and included in an updated agreement. Mayor Gubler requested Attorney Rawlings attends the Joint Work Session with Bonneville County on December 7th. Attorney Rawlings confirmed he is planning on it. Council President Geray stated the existing AOIA references the various Bonneville County zones that are permitted in the City's impact area. He asked whether it would be more appropriate to reference the City of Iona's zones and which of those would be allowed in the area of impact. Attorney Rawlings stated that is a possibility, but he is unsure if Bonneville County would approve it. Council President Geray stated he requested Clerk West add the Bonneville County Zoning Ordinance to tonight's packet for the Council to review which zones best correlate between the two entities. Mayor Gubler stated there is some overlapping language between the two Codes. Council President Geray stated he feels like it would be easier to find common Bonneville County zones the City feels comfortable with and implement those into the AOIA. Attorney Rawlings agreed it would be difficult for Bonneville County to adapt to the City of Iona's zoning in our AOIA. However, it would be conceivable for them to reference the Iona Subdivision Ordinance, especially for Development Agreements within the area of impact. Council President Geray suggested an idea to include specific Bonneville County zones that the City has pre-approved for use in the area of impact. He continued and stated if a developer wants to use a different zone, it would need to be presented to and approved by the Iona City Council. Council President Geray then began discussing specific zones he would consider allowing from 3 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 15, 2022 the Bonneville County and Iona City Zoning Ordinances. Mayor Gubler and Council Member Wadsworth both stated their desire to require City approval for all developments in the area of impact. Attorney Rawlings stated that would not be permissible unless the City was willing to take over the entire development process within the area of impact. Council Member Thompson stated if a development is contiguous to the City they should be required to annex into the City. Mayor Gubler stated Bonneville County already requires that. Attorney Rawlings stated they cannot legally require that in the AOIA. Discussion then began regarding the current area of impact map and what updated boundaries the Council will request from Bonneville County. Clerk West displayed a map on the projector to aid in the discussion. Council President Geray reiterated the City would like to extend the area of impact to 1st Street and cut out a notch for the Iona Cemetery,but that needs to be discussed with the City of Ammon. The Council discussed the potential northern boundary for the area of impact and whether it should go all the way to Highway 26 and possibly beyond. Chairman West stated the P&Z discussed this and suggested extending north of Highway 26 to capture and control some of the proposed high-density housing. Council President Geray stated he does not think the City wants the headache of those developments and does not think those residents will be using our roads and parks that often. Discussion then began regarding other developments currently being considered. Chairman West asked Mayor Gubler if he would like a representative from the City P&Z to attend the Joint Work Session with the City Council and Bonneville County P&Z on December 7th He continued and stated he will be there but will be representing the Bonneville County P&Z. Attorney Rawlings agreed that he cannot be a representative for both commissions during the meeting. Mayor Gubler stated he would like someone from the City's P&Z there, if possible, and instructed Chairman West to extend an invitation to his member of choice. Council President Geray asked if there is anything else that needs to be decided or discussed before they meet with Bonneville County. Mayor Gubler stated the first meeting is not a definitive meeting and is more to start the discussion between both entities. Clerk West stated when she spoke with the Bonneville County P&Z Assistant, she advised the City to bring any proposals and maps they want considered to the meeting. She continued and encouraged the Council to have more information prepared. Attorney Rawlings suggested having an Agreement drafted and maps to discuss with Bonneville County. Council Member Wadsworth agreed. STAFF REPORTS: Deputy Randall distributed paper copies of reports pertaining to police call counts and the type of calls and reports the City has received. Council reviewed and discussed various stats on the report. Deputy Randall highlighted the decline in domestic dispute calls over the past year. Deputy Randall reported there was a car theft in Iona, but the car was found in Pocatello and the thieves are currently in jail. Director Prouse stated Dome Technology started their final round of repairs for the leakage at the new water tank last week. He continued and stated they will retest it at the end of the week. Clerk West reported the Halloween Carnival and the Veterans Day program both went well and the City has received positive feedback for both events. Clerk West then reported she has received this year's invoice from the City of Idaho Falls Animal Shelter and it did increase again. 4 IONA CITY COUNCIL REGULAR MEETING—NOVEMBER 15, 2022 She continued and stated the math shows the City is paying approximately $700-$800 per dog that is picked up from Iona and taken to the shelter. Clerk West stated she has reached out to the veterinary clinic in Rigby that the City of Ammon use as a shelter, but they informed her they are no longer accepting new customers. Mayor Gubler stated if Bonneville County is already taking animals there and we have a contract with Bonneville County Sheriff's Office, why would we be required to have a separate contract with the clinic. Clerk West said it is the City of Ammon that has the contract with the clinic, not Bonneville County. Council President Geray asked what the current fee is for Iona residents to get their dog out of the Idaho Falls Animal Shelter. Clerk West stated the fee is $200. But the problem is that most of the dogs are unclaimed. Council President Geray expressed frustration in the financial situation the "no-kill" shelters have created for cities. He continued and wondered if there was another alternative to get a larger organization involved. Clerk West then asked the Council their preference on when the City Christmas dinner will be held. Mayor Gubler stated he has already started this discussion with James West, who manages the hotel where they held the dinner last year. Council President Geray asked if that is a conflict of interest. Attorney Rawlings stated he does not see it as an issue. Council Member Wadsworth stated he has been working with Director Prouse on future Code amendments to allow current residents the ability to restore their properties. Council President Geray stated the Veterans Day program went well and appreciates the City's continued involvement in the program. Council Member Thompson asked the date of the Bonneville County Commissioner's Meeting in January. Clerk West stated there has not been a date scheduled yet, but she will notify the Council as soon as there is a date. Council Member Mann stated the Veterans Day program was very well done and expressed his appreciation to veterans. He also reported the Iona Library is doing well and their systems are working great. Council Member Mann also stated the Recreation Director, Randy Homer, is doing a fantastic job. Clerk West agreed and stated they have already received over 130 team registrations for the winter basketball season. Attorney Rawlings asked if he should attend the Bonneville County Commissioner's Meeting in January. Council President Geray said he thinks that is a good idea. Mayor Gubler agreed.
