Estimated Cost of Implementation Attachments in Addition to Proposed Ordinance 1 The Town of Leesburg, Virginia PRESENTED September 12, 2006 ORDINANCE NO. 2006-0-51 ADOPTED October 1 L 2006 AN ORDINANCE: AMENDING AND REORDAINING SUB-SUB-SUBSECTION 10A.5.C.5 (DECKS AND PATIOS) OF SUB-SUBSECTION 10.4.5.C (EXTENSIONS INTO REQUIRED YARDS) OF SUBSECTION 1004.5 (MINIMUM YARD REQUIREMENTS) OF SECTION 1004 (MEASUREMENTS, COMPUTATIONS AND EXCEPTIONS) OF ARTICLE 10 (DENSITYIINTENSITY + DIMENSIONAL STANDARDS) OF THE ZONING ORDINANCE OF THE TOWN OF LEESBURG, VIRGINIA, 2003, AS AMENDED. The Town Council of Leesburg, Virginia, ordains: SECTION I. That Sub-sub-subsection lOA.5.C.5 (DECKS AND PATIOS) of Sub- subsection lOA.5.C (EXTENSIONS INTO REQUIRED YARDS) of Subsection 10.4.5 (MINIMUM YARD REQUIREMENTS) of Section 1004 (MEASUREMENTS, COMPUTATIONS AND EXCEPTIONS) of Article 10 (DENSITY/INTENSITY + DIMENSIONAL STANDARDS) of the Zoning Ordinance of the Town of Leesburg, Virginia, 2003, as amended, be and the same is hereby amended and reordained to read as follows: 5. Decks and Patios. Uncovered decks and patios, which are attached to the principal structure and are not more than three (3) feet above grade on the lot may extend into a required side or rear yard within five (5) feet of the property line for single-family detached residences and three (3) feet of the side or rear property line for all other residential uses. Uncovered decks, which are attached to the principal structure and are more than three (3) feet above grade on the lot may extend into a required rear yard to within twenty (20) feet of the property line, however, side yard requirements shall apply. The preceding setback requirements notwithstanding, if the rear lot line is 2 AN ORDINANCE: AMENDING AND REORDAINING SUB-SUB-SUBSECTION lO.4.5.C.5 (DECKS AND PATIOS) OF SUB-SUBSECTION 10A.5.C (EXTENSIONS INTO REQUIRED YARDS) OF SUBSECTION 10.4.5 (MINIMUM YARD REQUIREMENTS) OF SECTION 10.4 (MEASUREMENTS, COMPUTATIONS AND EXCEPTIONS) OF ARTICLE lO (DENSITYIINTENSITY + DIMENSIONAL STANDARDS) OF THE ZONING ORDINANCE OF THE TOWN OF LEES BURG, VIRGINIA, 2003, AS AMENDED. adjacent to an open space area of at least ten (10) feet in width, a deck may extend into a required rear yard to within fifteen (15) feet of the property line. A patio adioining the principal structure may extend into a required side or rear yard within two (2) feet of the property line for all residential uses subiect to buffer guidelines. SECTION II. This Ordinance shall become effective upon the date and at the time of its final passage. SECTION III. If any provision of this Ordinance is declared invalid, the decision shall not affect the validity of the Ordinance as a whole or any remaining provisions of the Ordinance.
