The proposed Ordinance deletes some of the setback requirements from certain
streets.

(MEASUREMENTS, COMPUTATIONS AND EXCEPTIONS)
OF ARTICLE 10 (DENSITY/INTENSITY + DIMENSIONAL
STANDARDS) OF THE ZONING ORDINANCE OF THE
TOWN OF LEESBURG, VIRGINIA, 2003, AS AMENDED.
The Town Council of Leesburg, Virginia, ordains:
SECTION I. That Sub-subsection 1O.4.5.E (ADDITIONAL SETBACK
REQUIREMENTS FROM CERTAIN STREETS) of Subsection 10.4.5 (MINIMUM
YARD REQUIREMENTS) of Section 10.4 (MEASUREMENTS, COMPUTATIONS
AND EXEMPTIONS) of Article 10 (DENSITY/INTENSITY + DIMENSIONAL
STANDARDS) of the Zoning Ordinance ofthe Town of Leesburg, Virginia, 2003, as
amended, be and the same is hereby amended and reordained to read as follows:
E. Additional Setback Requirements from Certain Streets. In addition to those
yard requirements established for zoning districts, the building setback
requirements established herein for certain public streets within the Town of
Leesburg shall also be applicable. In case of conflict with other provisions of this
Zoning Ordinance, the greater setback requirement shall prevail.

TOWN OF LEESBURG, VIRGINIA, 2003, AS AMENDED.
1. East Market Street. To implement the recommel'ldatioBs of the East
Market Street Design Study and the TfIWl'l Pkm, the follo'.ving setbacks
shall be required:
a. East Market Street, from the iBterseetioB '....,ith East Loudoun
Street to the interseetioB v:ith Catoetin Cirele: 70 feet from the
centerline of the right of ',yay.
h. East Market Street, from the interseetion with Catoctin Cirele to
the il'lterseetion '.vith Fort E':ans Road: 80 feet from the eeBterline
of the right of 'Nay.
e. East Market Street, from the intersectioB \vith Fort Eyans Road
to the interseetion with the Route 7/15 Bypass: 100 feet from the
centerliBe of the right of \wy.
2. Other IBereased Sethael~
la. Route 7, East of the Route 7/15 Bypass: 100 feet from the
right-of-way line.
lll. Route 15, South of the Route 7/15 Bypass: 100 feet from the
right-of-way line.

YARD REQUIREMENTS) OF SECTION 1004
(MEASUREMENTS, COMPUTATIONS AND EXCEPTIONS)
OF ARTICLE 10 (DENSITYIINTENSITY + DIMENSIONAL
STANDARDS) OF THE ZONING ORDINANCE OF THE
TOWN OF LEESBURG, VIRGINIA, 2003, AS AMENDED.
~e. West Market Street, north side only, between Ayr Street and
the western corporate limits: 100 feet from the centerline of the
right-of-way.
~d. Dulles Greenway Private Toll Road: 120 feet from the right-of-
way line.
~~. Increased Setbacks Based on Road Classification. No building shall
be located closer than 100 feet from the right-of-way of any limited access
highway, 80 feet from a major arterial road, 50 feet from a minor arterial
road, and 35 feet from the right-of-way of a through collector road located
in the area to the east side and/or south side of the Route 15 Bypass as
indicated in the Transportation Element of the Town Plan.
SECTION II. This Ordinance shall become effective upon the date and at the
time of its final passage.
SECTION III. If any provision of this Ordinance is declared invalid, the decision
shall not affect the validity of the Ordinance as a whole or any remaining provisions of
the Ordinance.
