HomeMy Public PortalAbout2007_02_20_O007 Approving TLZM 2005-0002 Oaklawn The Town of Leesburg, Virginia PRESENTED: February 20. 2007 ORDINANCE NO. 2007-0-07 ADOPTED: February 20. 2007 AN ORDINANCE: APPROVING TLZM-2005-0002 OAKLA WN REZONING AND CONCEPT PLAN AMENDMENT WHEREAS, Oaklawn LLC has submitted an application for concept plan and proffer amendment originally approved under #ZM-159 on June 9, 2003; and WHEREAS, the applicant proposes to increase the square footage of the day care use from 7,500 to 10,000 square feet within Land Bay MUC 5 within the PRC, Planned Residential Community Zoning District; and WHEREAS, the applicant proposes flexibility in location of one automobile service station in either Land Bay 2 within the PRC, Planned Residential Community Zoning District or Land Bay C within the PEC, Planned Employment Center Zoning District; and WHEREAS, on November 2, 2006, the Planning Commission recommended denial of this application for failure to comply with a Zoning Ordinance provision establishing a minimum square footage of 100,000 square feet of nonresidential uses; and WHEREAS, the staff recommended approval; and WHEREAS, on February 20, 2007 the Town Council held a public hearing on this application; and WHEREAS, the proposed concept plan and proffer amendment permits Town Council to mitigate potential adverse impacts through Special Exception review of the day care and automotive service center uses; and -2- AN ORDINANCE: APPROVING TLZM-2005-0002 OAKLA WN REZONING AND CONCEPT PLAN AMENDMENT WHEREAS, Council has concluded that approval of the application would be in the interest of public health, safety, general welfare and in accordance with sound zoning and planning principles. THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia that Rezoning TLZM-2005-0002 Oaklawn is hereby approved subject to the proffers last dated February 9, 2007: PASSED this 20th day of February 2007. ~~~L:~~f IS en C.
