WHEREAS, the City of Opa-locka Code of Ordinances, Section 21-77 Schedule of Rates Generally, sets rates for meter size, water usage rates per 1,000 gallons, sewer monthly service charge (residential and commercial), sewer usage rates per 1,000 gallons and storm water utility rates beginning on January 1, 2015 and increasing on October, 1, 2015, October 1, 2016, October 1, 2017 and October 1, 2018; and WHEREAS, the Acting City Manager desires to utilize the January 1, 2015 rates until the City of Opa-locka can complete a Water and Sewer Rate Study; and WHEREAS, the Commission of the City of Opa-locka has determined that the following amendment to the City's Code of Ordinances will be in the best interest of the City of Opa-locka; and WHEREAS, the Commission of the City of Opa-locka desires to enact an ordinance amending Chapter 21 Water, Sewer and Storm Water Utilities Section 21-77 Schedule of Rates Generally. NOW THEREFORE,BE IT ORDAINED BY THE COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA AS FOLLOWS: SECTION 1. RECITALS. The above recitals are true and correct and incorporated herein as though fully set forth below. Ordinance No. 18-13 SECTION 2. ADOPTION That Section 21-77 Schedule of Rates Generally is amended as follows: All October 1, 2017 rates will be changed to January 1, 2015 rates. SECTION 3.SEVERABILTY If any clause, section, or other part or application of this Ordinance is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application,it shall not affect the validity of the remaining portions or application of this Ordinance. SECTION 4. CONFLICT All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith, are hereby repealed. SECTION 5. CODIFICATION This Ordinance shall be codified in the Code of Ordinances when the code is recodified. SECTION 6.SCRIVENER'S ERRORS. Sections of this Ordinance may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected or re-codified copy of same with the City Clerk. SECTION 7.LIBERAL CONSTRUCTION. The terms and provisions of this Ordinance shall be liberally construed to affect the purpose for which it is adopted. SECTION 8.EFFECTIVE DATE. This Ordinance shall take effect upon the adoption of this Ordinance by the Commission of the City of Opa-locka and is subject to the approval of the Governor or his designee. This ordinance was moved for adoption by Vice Mayor Kelley. Staff will re-visit the rate study in the near future and present further recommendations to the City Commission for review and/or approval. This charge covers the cost of installation, replacement, repair and maintenance of fire hydrants, in addition to the cost of upgrading water mains to provide required fire flows.
