AN ORDINANCE: TO AMEND AND REORDAIN ARTICLE I (IN GENERAL) OF CHAPTER
11 (OFFENSES - MISCELLANEOUS) OF THE CODE OF THE TOWN OF
LEESBURG, VIRGINIA, 1976, AS AMENDED, BY ADDING A NEW
SECTION 11-17 (D) (NIGHT CONSTRUCTION ACTIVITIES)
The Council of the Town of Leesburg in Virginia hereby ordains:
SECTION I. That Article I (IN GENERAL) of CHAPTER 11 (OFFENSES-
MISCELLANEOUS) of the Code of the Town of Leesburg, Virginia, 1976, as amended, be and the
same hereby is amended and reordained to add a new Section 11-17 (d) (NIGHT CONSTRUCTION
ACTIVITIES) to read as follows:
Section 11-17 (d). Night Construction Activities.
The town manager shall have the authority to approve the operation of construction
equipment that may generate noise between the hours of 10:00 p.m. and 6:30 a.m., and not
be in violation of Section 11-17, when such a case is presented that it is in the best interest of
the public, for public improvements and to provide for public safety, to perform construction
activities between said hours. Examples - significant impact to businesses, pedestrian
safety, traffic volume and traffic control safety, etc. Staffwill endeavor to avoid as much
night construction in residential areas as possible. Staff shall ensure that the residents and
businesses affected are properly notified in advance prior to construction.
SECTION II. This Ordinance shall become effective upon the date and at the time of its
final passage.
SECTION III. If any provision of this Ordinance is declared invalid, the decision shall not
affect the validity of the Ordinance as a whole or any remaining provisions of the Ordinance.
