The regular meeting of the City Council of the City of Temple City was called to order by Mayor Nunamaker at 7:30 P. M. 2. Reverend Roger Hillis of the Westminster Presbyterian Church of Temple City gave the invocation, followed by the Pledge of 3. Allegiance to the Flag led by Mayor Nunamaker. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford & City Manager Woollett 5. APPROVAL OF MINUTES: Regular meeting of January 27, 1964. Councilman Fitzjohn moved to approve the minutes of the regular meeting of January 27, 1964, as mailed, Councilman Merritt se- conded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED BUSINESS: PUBLIC HEARING: 7 :30 P. M. APPEAL FROM PLANNING COMMISSION DECISION ZONE CASE NO. 63 -71, N. W. CORNER BROADWAY & TEMPLE CITY BLVD. Councilman Tyrell moved to open the Public Hearing, Councilman Merritt seconded, and carried. Planning Advisor. Cushman explained this request for a conval- escent Hospital at 5503 Temple City Blvd. and explained the plot plans for the buildings and parking lot. There would be a frontage on Temple City Blvd. of 208 Ft. and on Broadway of 390 Ft. Under the new zoning ordinance this area would be R -3 and this use requires an R -4. Under the present zoning ordinance this use requires a C -3. Mayor Nunamaker asked if ahyone wished to speak in favor of this request. Mr. Fred Garside, 479 Rosemary Dr., Arcadia, who proposes to build and operate this convalescent hospital stated, he felt it would be a great improvement to the area as it would be a beauti ful building and grounds, which would have to be maintained in side and out to meet state standards and requirements, that this type of development would not incur traffic and school problems which an apartment would, and he felt it would be an asset to the City of Temple City. The following people spoke in favor of the development as re- quested: Mr. Don Neilsen, 5524 Temple City Blvd., Mr. Pat Denardo, 6117 N. Sultana, Mrs. Thomas Schaub, 5526 Temple City Blvd., Mr. Tom Schaub, 5526 Temple City Blvd., Mrs. Clara Edwards, 9609 E. Broadway. City Manager Woollett advised he had a communication from 57 people representing 40 properties indicating they are in favor of this convalescent hospital. Mayor Nunamaker asked if anyone wished to speak against this proposal. Mr. George Knittle, 9533 Broadway, stated his property adjoined immediately on the west and he was opposed to this development. Mr. Beddome, 9568 E. Broadway, felt it would reduce the value of his property. The following also were opposed: Mr. Richard Engels, 9556 Broadway, Mr. Ralph Morris, 5512 Temple City Blvd. Chairman Beckley of the Planning Commission advised the same opponents had appeared at the Public Hearing before the Plannino Commission, but that these property owners favoring the develop- 575 Council Minutes, February 10, 1964, page 2 ment had not appeared at that time, and he did not recall any - other than Mr. Garside that spoke in favor of the project, and from the testimony at that Public Hearing this type of estab- lishment would not be too acceptable at that location. Councilman Merritt moved to close the Public Hearing, Councilman Fitzjohn seconded and carried. There followed considerable dis- cussion by the Councilmen. The question of noticing came up and the City Attorney stated if there were a question in this respect it would be best to put the Hearing over until next meeting and have anyone step forward if they were not noticed, and if not given a proper notice the proper course would be to send this back to the Planning Commission. The burden is on the applicant to step forward with affidavits to the City Maria,- ger that the people did not get notices and the City Manager can act on it. Councilman Dickason moved to have this held over to the next Council meeting, Councilman Fitzjohn seconded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt NOES: Councilmen - Tyrell, Nunamaker ABSENT: Councilmen -None City Attorney Shatford advised if no proper evidence is submit- ted by the next meeting this should be determined before the City Council. PUBLIC HEARING: 7 :30 P. M. VACATION OF PORTION OF ARDEN DRIVE NORTH OF FREER STREET. Councilman Tyrell moved to open the Public Hearing, Councilman Fitzjohn seconded, and carried. Planning Advisor Cushman stated this vacation was necessary for completion and recordation of this tract and the City determined to remove the proposal for an 30 ft. wide street and at that time indicated they would per- mit this vacation. Mayor Nunamaker asked if anyone wished to speak against this and no one came forward. He then asked if anyone wished to speak in favor of the vacation, and no one came forward. Councilman Fitzjohn moved to close the Public Hearing, Council- man Merritt seconded, and carried. Councilman Tyrell moved to instruct the City Attorney to draw a resolution vacating a por- tion of Arden Drive, Councilman Fitzjohn seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 6. REQUEST FROM CAMELLIA FESTIVAL FOR SUBSIDATION OF TELEVISION COVERAGE OF PARADE. Councilman Fitzjohn advised the Camellia Festival had made other arrangements for the subsidation of the television coverage of the Camellia Festival Parade and so no further action was taken, 7. ORDINANCE NO. 64 -122 PROHIBITING THE MAINTENANCE OF CERTAIN CARTS, WAGON3 AND STANDS WITHIN THREE HUNDRED FEET OF ANY PUB- LIC SCHOOL GROUND. 2nd reading. City Attorney Shatford read title to Ordinance No. 64 -122 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING SECTIONS 4263.1 and 4263.2 TO THE TEMPLE CITY MUNICIPAL CODE TO PROHIBIT THE MAINTENANCE OF CERTAIN CARTS, WAGONS AND STANDS WITHIN THREE HUNDRED FEET OF ANY PUBLIC SCHOOL GROUND IN THE CIT' OF TEMPLE CITY, AND LIMITING VENDING TIME IN ALL OTHER LOCATI- ONS. Councilman Tyrell moved to waive further reading, Council- man Fitzjohn seconded,carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Councilman Tyrell moved to adopt Ordinance No. 64 -122, Council- man Merritt seconded, and carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 576 Council Minutes, February 10, 1564, page 3 8. REPORT OF SUFFICIENCY OF PETITION FOR PARKING DISTRICT NO. 2 City Manager Woollett reported the Petition submitted at the last Council meeting for Parking District #2 is sufficient, and more than 50% of the property owners and more than 60% of the land value have signed up. Councilman Tyrell moved to receive and file this report, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrellr, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None RESOLUTION NO. 64 -347 ORDERING A REPORT UNDER THE SPECIAL ASSESS- MENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931, VEHICLE PARKING DISTRICT NO. 2 City Attorney Shatford read title to Resolution No. 64 -347 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIF- ORNIA, ORDERING A REPORT UNDER THE SPECIAL ASSESSMENT INVESTIGA- TION, LIMITATION AND MAJORITY PROTEST ACT OF 1931. Councilman Dickason moved to adopt Resolution No. 63 -347, Councilman Fitz - john seconded, carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None NEW BUSINESS: 10. RESOLUTION NO. 64 -348: APPOINTING PART -TIME AND TEMPORARY EMPLOYEES - Recreation Dept. The City Manager read title to Resolution No. 64 -348 A RESOLU- TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PART -TIME AND TEMPORARY EMPLOYEES. Councilman Tyrell moved to adopt Resolution No. 64 -348, Councilman Merritt seconded, and carried by the following called vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 11. REPORT RE PROPOSED AMENDMENTS TO AGREEMENT FOR IMPROVEMENT OF RAILROAD CROSSING ON TEMPLE CITY BLVD. City Attorney Shatford advised this project was temporarily delayed because the City Attorney of Rosemead had some objection to which he did not agree and felt the Agreement as drawn was good. The City Mana- ger suggested as long as the City Attorney approved the Agree- ment that the City Council instruct the City Manager to return these Agreements to Rosemead for signature indicating we approve and send copies of the letter to the Public Utilities Commission and the City of El Monte and the Southern Pacific Railway Co. Councilman Fitzjohn so moved, Councilman Tyrell seconded, and carried by the following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 12. PLANNING COMMISSION RECOMMENDATIONS: a. Report on proposed classification changes on Zoning Map. The City Manager advised this report was received back from the Planning Commission and recommended the Council receive and file until such time as the map and ordinance are presented for adop- tion. Councilman Merritt so moved, Councilman Tyrell seconded, and motion carried. 13. TRAFFIC COMMISSION RECOMMENDATIONS: Item 8. Recommend installation of 20,000 lumen light at Live Oak and Holly Item 9 (1) Removal of red parking zone north side of Lemon westerly of Temple City Blvd. Item 9 (4) Installation of crosswalks at intersection of Olive and Baldwin Ave. Item 10 (1) Granting of Parade permit to Camellia Festival and installation of blue line down center of street. 577 Council Minutes, February 10, 1964, page 4 Item 11 Gradual removal of Stop Signs at signalized intersec- tions per 1963 legislation. Commissioner Georgia Maxey explained the above recommendations of the Traffic Commission. Councilman Tyrell moved to approve these listed recommendations of the Traffic Commission, Council- man Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 14. SET PUBLIC HEARINGS FOR CURB & GUTTER PROJECTS: a. Loma Ave., east side, Olive to cul -de sac b. Loma Ave., west side, Olive to cul -de -sac c. Garibaldi, north side, Golden West to east City boundary d. Daines Dr., south side, Halifax to Pal Mal The City Manager recommended the above projects be set for Pub- lic Hearing on February 24, 1964, at 7:30 P. M. Councilman Tyrell so moved, Councilman Merritt seconded and carried. 15. RESOLUTION NO. 64 -349: WARRANTS & DEMANDS IN THE SUM OF $52,746.30 DEMAND NOS. 4563 through 4632. Councilman Fitzjohn moved to adopt Resolution No. 64 -349, warrants and demands No. 4563 through No. 4632 in the sum of $52,746.30, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None 16. APPOINTMENT OF REPRESENTATIVE TO LEAGUE OF CALIFORNIA CITIES: Mayor Nunamaker appointed Councilman Dickason as a member of the Council to represent the City at all Los Angeles County Convention League Meetings to. which Councilman Dickason agreed. 17. COMMUNICATIONS: (1) Los Angeles County Boundary Commission, proposed Annexation No. 60 and No. 63, South El Monte. The City Manager presented the above communication. Councilman Fitzjohn moved to receive and file, Councilman Tyrell seconded, and carried. 1 8 . TIME FOR THOSE I N THE AUDIENCE WHO WISH TO SPEAK: Chas. Oakley, 6164 N. Rosemead, again complained regarding the property next to his, that the owner is still making chairs, and all he wants is for him to clean the place up. Following discussion Councilman Tyrell moved to have the City Attorney prepare an "unsightly" ordinance for the next meeting, Council- man Fitzjohn seconded, carried by the Following called vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Tyrell, Nunamaker NOES: Councilmen -None ABSENT: Councilmen -None Traffic Commissioner Georgia Maxey stated the Council might be interested in the drawings Traffic Engineer Envall is preparing concerning the Temple City railroad crossing. 19. The City Manager advised work started today on the Encinita railroad crossing. Councilman Fitzjohn asked regarding the report on Parking Dist. No. 2, and the City Manager advised this would be made at the next meeting. Councilman Merritt asked about the sidewalks on Golden West and City Manager Woollett advised there was some delay involved due to one property owner protesting the installation, but that it would go forward now as rapidly as possible. Councilman Tyrell stated he did not wish to be reimbursed for the dinner on Feb, 6 and did not think it an appropriate expen- 578 Council Minutes, February 10, 1964, page 5 diture for the Council to which the other Councilmen agreed. City Manager Woollett read a request from the Kai Sons for a car wash at Ray's Standard Service Station, on the northwest corner of Alessandro and Las Tunas on February 22, the funds to be used for charity. Also a letter from the Temple City Key Club requested a permit for a car wash at the same location on Feb.. 15, 1964, between the hours of 9 A. M. and 5 P. M., the funds to be used to place a Ram's head in the square at Temple City High School. Councilman Tyrell moved to grant both requests, Councilman Fitz - john seconded, and carried. Mayor Nlunamaker read a request for the week of Feb. 26 to be be proclaimed as "Brotherhood Week ". Councilman Fitzjohn so moved, Councilman Merritt seconded, and carried. 20. ADJOURNMENT: Councilman Merritt moved to adjourn, seconded and carried. Coun- cil adjourned at 9:10 P. M . until the next regular meeting on February 24, 1964, at 7:30P. M. at the City Hall, 9664 E.
